@Yas I That is due to a high approval rate though. The statistics shows there are a lot of people being granted EB I-140. Several people who got denied EB1A/EB2 NIW reapplied during this present administration and got approved. The visa ran out because of the congress limit which has nothing to do with the present administration. But the running out of visa shows that people are truly being granted visas though compared to the past where people were denied I-140 or AOS without even a RFE. The previous administration was way more difficult than this, which is why lawyers have been advising people to apply during this current administration. I still prefer this administration even with the backlog because at least they are still lax.

Former administration were faster with EBs, bulletin was current most of the time. Biden admin has gotten swamped by asylum seekers and other humanitarian stuff.

@Ashleigh Brands I agree that this administration has slowed a lot of things down with high amount of people crossisng the border illegally and asylum petitions but all experienced lawyers I have spoken to said this administration is way better and lenient towards Legal immigrants too. Remember the previous administration wanted to limit work visa (h1b) to only top income earners, which would have eliminated majority of people including recent graduate on student visas and also proposed limiting student visas to a 2 year limit (eliminating duration of stay) and students were meant to request for extension and they could be denied and told to leave the country. He also made a lot of the policies that made adjusting of status hard like the financial support Form I-944 (which Biden discontinued) and may others. Bulletin was current because there were less approvals, a lot of lawyers told me this. There was harder scrutiny. A lot of students on visa lost their status during pandemic due to lack of funds and this current administration was lenient (several lawyers said the same thing) with reinstatement and some of those individuals I know got EB approved and got their green cards. Under the previous administration people were scared (unless they were sure) of applying for EB visas because they knew it will be hard getting a non-immigrant visa again on an approved I-140 but current administration changed the rule that an approved I-140 should likely not affect future non-immigrant visa if denied I-140. Statistics shows the backlog of Eb2 is caused by a high number of NIW petition which is now more than company sponsorship. I get the frustration but eb2 niw has become so popular to those in USA and outside and that is where the backlog is coming from. it is the same with eb3 unskilled. too many people are signing up through agencies which has caused backlog. The previous administration was definitely not friendly towards legal immigration too.

@Yas I I understand and agree that there is no organization at USCIS. This has always been the issue no matter the administration. The officer reviewing your case makes a big difference. Some are just slow. The same way some people get approved I-140 fast while some have to wait months or years for a decision. An Individual I know still has a pending 2016 eb2 niw that has still not been decided yet he turned in another one in 2021 and got approved within 3 months. Some people are just lucky to not stay in CRP at all or not for too long. It is the same for other green card based petition. Hoping you get a decision soon. Are you still maintaining your non-immigrant status?

@Mrs Mrs I understand your points but in my case, I don’t feel like this administration help me in any way. For sure, any Inmigration Lawyer love Democrats government cause they got more jobs. People with a strong Employment case is suffering now and in the immediate future the consequences from this soft hands. In a “normal” world government rather people with some technical and management background over people just crossing the borders

@Raul Mayor I understand the frustration but there is always going to be several cases that are stuck in CRP. Soon, you shall get approved. I agree that the open boarder has made things overwhelming for everyone but remember those migrants have it worse than us because there is no pathway to greencard for them due to illegal entry and asylum has a high denial rate while most will be stuck with minimal jobs. I won’t want to be in their shoes. So, we on here are still in a better state than illegal migrants. Hope you get your GreenCard soon though.
