Premium processing/ filling i485 simultaneously
Hi,
I have a question.
My priority date is August 15, 2024, and my I-140 is still pending with the status showing as "actively reviewing." I haven't received a response yet.
Can I request premium processing for my I-140 and simultaneously file my I-485, even though my priority date is not yet current?

I am not a a lawyer but to my knowledge, you can file premium processing but not I-485 simultaneously unless visa bulletin is current for your date of filing and USCIS hasnโt asked you to follow final action date table

It wonโt work that way. Your I485 will be denied because it is not current. The I140 on PP, will be processed within 45 business days.
Use an app to calculate this accurately, taking into account U.S. vacation days. I see many people complaining about waiting for 60 days, but they're not even at 40 days yet!

Thank you! Iโve seen so many people waiting for two years just to get a response on their I-140. At least with premium processing, Iโll only have to wait 60 days... but I heard that when you file for premium processing, USCIS is more likely to issue an RFE.

If your date is not current and you are from a backlogged country you might be better off opting for premium processing. And if it is EB2NIW then it is 45 days if it is EB1A then you will get a response in 15 days for your I 140... You need to have an approved petition to secure a priority date.

thank you all for your responses. itโs a EB2 NIW - ROW (France). Iโm already in the US with J1 visa that has to be extended this year for 2 years. I hope I will get a response before this date

@Kar NIW i140-Nov 2023โ it seems I need to understand this. You mentioned 45 business days. My question, is it really 45 business days or 45 calendar days. I have 4 friends that used premium processing which came out less than 45 calendar days. Thank you

It takes approximately 45 business days, excluding vacations, holidays, and U.S. celebrations. If a response is received sooner, that is preferable, but the average processing time is currently 45 business days.
Eg. If I submit a PP on January 27th 2025, I should spect an answer around April 2nd 2025.
