@Idisowon I don’t think I-751s can be expedited because your Resident Permit was extended by 18months when you filed so your status is not in jeopardy and nothing changes so there’s really no reason to expedite your case

yeah hopefully mayorkas will do something to speed it up 1 year wait is acceptable given the load of work but more than that is absurd. and RFE are always the worst. I think they should request RFE right away within 3 months of case being received so that there is no wastage of time rather than wait 1 year and then request more info.

Exactly a lot happen to people while that application is on the way. imagine people that lost their documents in wild fires and hurricanes and you are issuing the an RFE after almost two years. Potomac is the worst

yeah I totally agree. I’m scared that it would be a 2 years wait and then RFE. I’m doing waiver case i751 so I’m definitely expecting an interview despite the fact thag I sent quality evidence and lots of it too. anyone got approved with i751 waiver yet?

Ok he already filed jointly before he started having issues with his wife. Currently they still live together and she has agreed to still support his case but with the delays he is not sure how long she can hold on. They are going to live apart by the end of the year. He is confused if he should tell USCIS that he is having issues with his wife or wait until the divorce process starts officially. Also will them living apart at the end of the year raise red flags. I am kind of knowledgeable about family based immigration but this one beats me 😂

well that’s kinda tricky, I would let immigration know when they actually start the divorce process, people fight all th time but yeah if it’s something that is way too much I would say it’s better to divorce and compete the case alone than go in with a spouse who may not be cooperative at the interview and that will delay the case even more and even create problems for the GC holder. and they have to stay together until the GC is approved if they are going to be living separate means physically separate then i think he should notify immigration that they are separating and wants to convert the case to a waiver. because once you SEPARATE and still want to continue the application as a JOINT application that is gonna be consider a misrepresentation

even if the spouse is willing to help out, it’s going to be a problem because you have to be living together til the end.. so once you split that’s the end of the joint application and immigration will find out so it’s better to be honest upfront and convert it into a waiver than to lie and be in deportation later when you could have been honest and get your GC through waiver case

His state has a 1 year mandatory separation before divorce. What if he is separated and his case is approved before the divorce starts?

so yeah if you have a child then you have to be separated for a year. well once you move out you should notify immigration that you are separated and want to convert the case into a waiver and they will convert it and once the divorce is finalized which can take 1 year plus some time depending on if it is contested or non contested they will send an RFE for the divorce decree. you should let them know once you separate, if he knows in his mind that he is not going to be together either the spouse it’s better to start the separation right away and let immigration know so that he can have his decree in hand in time to respond to the rfe down the line as it will take more than a year before the divorce is filed in the court.. and then you have only 87 days for the RFE.. so j would act quick on that one.. if you don’t let immigration know that you were separated while your case was approved then he will have problems down the line if and when you apply for N400 or do anything with immigration and if they find out they will put him in deportation and that would be not be good

also when you renew your GC even if you never file for citizenship then will give him problems and even put him in removal so it’s better to be honest that’s my opinion

yep. especially when you have a child which I think your friend does, not sure just guessing getting a waiver case approved is even easier.. since he is talking about 1 year separation I assume they have a child so with a child waiver cases are much easier

yeah so he should convert the case into a waiver if they are not able to live together, I’m not advising anyone to split up but if you can’t live together it’s better to do a waiver especially with a child you have much greater chance to get it approved

yeah no worries. we help each other. and yeah but if he does decide to move out make sure he gets all the evidence to prove his marriage because he won’t be able to get it once he moves out I think.. and also he might not get an interview just submit the child’s birth certificate any other questions. ? I definitely expecting an interview though

yeah since our PDS are one month apart so yeah pretty close I don’t believe it’s correct it will be one year for me in December I don’t think Potomac will approve my case in a year that would be big surprise if they do lol. do you believe the prediction?

I think the prediction is done under normal circumstances. There is nothing normal about Potomac Lol. Unless something drastic happens like they hire more people or transfer a shit load of cases out to maybe TX or Vermont then I don’t believe it

yeah true. they should transfer cases to TX. TX seems to have least amount of workload. I have seen many approvals in less than 6 months without interviews and RFE from TX. and California and Potomac Nebraska are not moving or moving very slow

Rocco how longwoukd you wait before you think you would take any action like Mandamus or something? I would give them full 18 months and then if I’m still waiting I would think of doing something. I don’t call them as it is useless to talk to 3rd party call center who know nothing about your case but just provide general info. they are good for general info though lol
