Please I need your input
My case is not going as expected. I schooled here in the US. I completed my bachelors in nursing in 2021 then went for opt after which my employer filed for me and my 3 dependents. After labor certification, then my attorney started filing. Along the line, the attorney made a mistake by not complying with the required number of days before submitting the EAD/485 because she had filed concurrently, then she received a letter saying the application was denied in 2023. She the fixed the mistake and resubmitted for the EAD, she did premium processing and within two weeks, my EAD and those of my dependents were out and we went back to work. Prior to this time, I had to go back to school because I came in as an international student so I have to be in status in order to change status. When my EAD came out, the attorney said the next thing we are waiting for is my green card. She also advised that I can stop taking classes because I didn’t really need it anymore as I have a pending case and legal in the country. We would chat with Emma and follow up with the attorney and was informed that my case is processing normally, not until August 29th 2025 when I checked on lawfully and saw that my case was denied. When we received the denial notice, they stated the reason for denial was because when the initial EAD was denied, the 485 that was filed concurrently was also denied. We have been devastated since then. We filed 290B motion to appeal and reopen. I was advised to return to school and get a new I-20 and of course my sevis has be en terminated because I stopped taking classes since 2023. We just filed form 539 to reinstate me. I know my case is getting complicated but any useful advice would go a long way. I don’t know what the outcome will be… please help a sister.

this is a very complicated issue, I will advise seeking counsel from two or three highly qualified immigration lawyers on what to do. my advice is always keep your F1 active until you finally receive your green card just to be safe. I am waiting for green card approval. I currently have my EAD but I’m careful not to use it because once I use it, I am no longer in F1 status. It look la like you should try to refile or appeal.

hang in there. normally an appeal to re-open a case is a long shot. my advise, since you have a receipt number, regularly check your application for any progress at least once a week. keep in mind that our lawyers are working on a lot of cases and they have no time to check app status of their clients on a regular basis.

discuss with your lawyer for a plan 2 or back up plan. i used to be in your situation, being proactive and vigilant would cause you no harm.

The appeal to consider and reopen was dismissed because there is no new evidence. I just received the appeal decision today. I honestly don’t know if I will be reinstated as an international student given that I’ve been gone from school for about two years. I was misguided by my attorney. she sent me an email saying since I have a pending 485, it’s ok for me to stop school.

an appeal to reopen must be accompanied by additional documents justifying the reason for denial.

discuss with your lawyer for a back up plan. an employer change might work, repercussion is you have to start the process again.

don’t give up, think of your dependents. I’m sure there are still other ways. your case is somehow similar to mine - denials, 290B, back to zero, change employer. almost 6 years in the making before receiving our green cards. there is still hope.

my I-140 was denied due to non compliance of the regulations. it was filed concurrently with my 485. The 140 was resubmitted but not the 485 per the attorney, it wasn’t denied. Not the uscis is saying that when the initial 140 was denied, the entire package was denied

Yes, my I-140 has been approved over two years ago. The thing is when the attorney filed my first 140, she also submitted the 485 concurrently. The 140 was denied due to her mistake. She then refiled the 140, but failed to also refiled the 485 because the first 485 was automatically denied along side the initial 140.
