PLEASE, ENLIGHTEN ME, GUYS. FOR EMPLOYMENT BASED I-140 PETITION, HOW DOES THIS WORK?
So, when you are filling the I-140 Application form, there is a portion where you are asked to put the names of your dependants (Spouse, kids). If you did and your petition gets approved,
1. After your 140 approval, can you immediately apply for your spouse/kids(under 21) or you have to wait till you get the actual GreenCard?
2. Does your spouse/kids have to file I-130 forms, then get approved before they can get their GC?
How does this work, please, enlighten me, guys.

@FlyHigh ❤️ it is always good to apply along with your spouse and kids at the same time provided that your PD is current. Yes, each applicant needs to file Form I-485 and I-131, but not form I-130. Your spouse and you will need to file form I-765 for EAD too.

@Sa O , so when my 140 gets approved, I can immediately file 130 for each of my spouse and kids or I have to wait until I get the actual GC in hand?

@FlyHigh ❤️ once your I-140 is approved and your priority date is current (final action or filling date), it is better that you apply for all of them at the same time with you. it saves time and money.

you can’t file form I-130 for your dependents if you are not a green card holder. If you and your dependents are in US, use form I-485. otherwise, you need to follow consular processing process.

2) I don't think that dependents have to apply for i-140 since they are already in i-140. They already have a legit reason for GC. 1) It depends. If you will do AOS and your dependants will go IVP then they will need to wait for your GC. If you both decide to go IVP then you will get it at the same time.

To answer your question if your dependents are outside the US you have to wait for your GC and file form i-824(follow to join). If they are here in the US then file an i-485 form and add them as dependents

He doesn’t have to wait till ur GC is ready file them now before you get the approval.. remember to file i130 for them each
