you can but I don't think it's a good idea file i130 first that's what you really going to need then you can adjust later your i130 should have been file already what you waiting for you better make sure you get it approve before court date

yeah tell him to do it asap cause i130 can takes a long time to approve mine took 11 months

so he can just file the 130 then once it gets approved , used that letter at his court & then do adjustment of status. i recommended a lawyer but lawyers asking alot of money just for consultations

yeah that's what he need to do but when it comes to immigration I highly recommend a lawyer I had to get one she did great for me in no time
