pending i485
please I need someone to help me and explain to me in details how to go about this
i have a pending i485 my husband filed for me . we are now separated due to abuse . i now want to switch to vawa. pls how can i keep receiving ead based on the pending i485 while i vawa and wait for that decision. my lawyers keep telling me i have to file q different i485 because they are two different cases but i know i can keep my ead valid and that i485 pending till q decision is made on the vawa I am about to file . how do i do that

1. write a letter to the uscis office that has your application and tell them your intention to self petition
2. state in the letter you want to put your 1 485 (thru your spouse) in abeyance
if they get your letter, they will give u a grace period of 30 days to provide them with evidence that u have filed an application with vermont.
if u have already done your bio, you can receive your ead

Please consult with an attorney first. Converting petitions could be tricky and they will hep you. I hope everything works out for you.

You don’t have to apply for another I-485. Since your current I-485 is still in the system, you will switch it over to vawa.

I went for my interview alone and asked the officer to keep it in abeyance as I am planning on filing vawa. she assured me that she would for 2 months. after about 2 weeks , it was denied . my ead renewal was denied too. now I have to pay the fees and start all over if I want to stay married to my husband or fil under vawa. I am out of work now with our child, so sad but I know it will end well.

Oh no! I was so sure you were going to be able to file for Vawa. No! mikky, file for Vawa AGAIN! I guess you don’t have an atty right? Where are you located? Let’s try to figure out what we can do to get you on the right track.

Mikky you shouldn’t have done that and reading from the chat here, no one advised you to use that approach, it was all wrong. Now is time to fix this.
Like K P said, 2 options are available. Vawa or you get married again or go back to your abuser.
choose Vawa. It will take you 6months to get work authorization so u can work. None of the other choices will give you EAD soonest as you will either wait 6 months after divorce to remarry or file afresh with abuser.
Continue with Vawa, the I485 is over, you’ll have to pay afresh for it in your Vawa and the testimony of what happened and why your first I485 was denied will be a good story when you go for the future i485 interview for your Vawa

Hi Everyone, will be really grateful if you could help answer this question. My I-485 thru marriage was recently denied cuz USCIS asked me for the I-360 thru an RFE but my lawyer sent a letter to USCIS stating that we havent received a receipt for I-360 from USCIS but the case has been filed with the Vermont centre.
USCIS denied my I-485 and I still havent received receipt for I-360 for my VAWA case. Can is still work on my EAD which I got due to my marriage based GC?
