pending i485 and o1
hi
so I have a pending I485 and rfe for i140….
I approved for o1 and have to go to my home
consulate office.
what major
implications does this have if I return on o1? I’m
guessing the i485 gets cancelled. but if I answer the rfe and it’s a success it could mean that I can file i485 again and if it’s not successful I just stay on o1 and refille if I wish?

if you have a pending 485 and travel outside US on 01 visa, you status gets invalidated and you can re enter on advance parole and work on ead. that’s what my lawyer said. other can chime in as well.

@Pritesh Jain hi pls clairify what you mean. if I wasn’t so bothered about i485 and just re entered with the O1a stamp what would happen

This is what my attorney told me once I submitted my I485, "I can travel as long as I use my current status (unexpired and valid) that is stamped H1b to travel and re-enter. And most importantly I plan on to resume work with the same employer."
