Pathway = Consular Processing to I-485
I selected that I would be going through consular processing in my I-140 petition but later decided to go through USCIS by filing I-485. My I-485 is currently pending (with the priority date being current). I am wondering if my case needs to be transferred from Department of State to USCIS. The current status of my I-140 is "Cas was sent to the Department of State". Will the status of my I-140 change when it goes to USCIS office during I-485 review? Please could somebody share their experiences? #i485 #USCIS #NVC #NBC #EB2NIW #approved

I am in similar boat. USCIS recalls your application from DoS after you file I485. but that adds time. I believe USCIS waits for 4 months or so after the request is sent and if DoS does not send the document then they just proceed to adjudicate it normally. that’s what someone told me who looked into the USCIS manual.

I used this path - it is pretty straight forward. You don’t have to do anything. USCIS will just use your approved I-140. I got my I-140 approved in April, received welcome letter from DoS a month later, I-485 was approved in July with no actions from my side. the only thing you need to keep in mind - if your I-485 is not approved within a year you have to go and fill the documents for DoS or they may consider your application abandoned and cancel I-140. This was from my laywer.

@G S glad to meet you here. My I-140 was approved a year ago. I filed my I-485 in April 2023. USCIS sent RFE for medicals last month. There’s no update on the movement of approved I-140 petition from NVC to USCIS/NBC. Will they still wait for my petition from NVC or make a decision based on its approval? How long would be my waiting time further? my priority date is current since September 2023.

They will not send your petition from NVC to USCIS as USCIS already has your petition on file. You should already have NVC welcome letter. I would check that (don’t know how). I have submitted my medicals with application so I don’t know how long it usually takes after RFE but it is a good sign :) it means USCIS has already started working on your I-485.
