Options for Children After Parental Green Card Denial
Hello. Is it possible for children to obtain EB2 or H1B visas after their parents' employment-based green card application is denied? I was included in the case before turning 21, but recently received a NOIR and think I need to prepare. I have recently graduated from a U.S. dental school and have a license.

depends upon the reasoning in denial letter. Does the letter at any point say you are inlegible for the benefit ?

Our case is pretty complicated. The Notice of Intent to Revoke (NOIR) indicates that 1) the signatures of the employer involved in the case did not all match, 2) the employer stated they could not remember whether they had signed the documents due to the age of the case, 3) they denied that the signatures were theirs, and 4) a review of past documents showed that there was no mention of the employer hiring on a full-time basis. The attorney handling the case at that time has since closed their practice, and is currently unreachable. A new attorney has been sought to proceed with the case. We also changed our sponsorship and applied for 485j right after we found the initial had a problem.

@Hay N your attorney needs to do a FOIA on your file , this sounds serious they need to know if the government accuse your parents of immigration fraud.
