NOTICE OF ACTION I-797
My I130 was approved but the notice says that my petition has been retained. Is it going to take another couple of months?
the notice stated that…”The above petition has been approved. However, you indicated on the petition that the beneficiary intends to apply for an immigrant visa abroad at a U.S. Embassy or a U.S. Consulate and willalso apply for adjustment of status in the Onlted plates. Since you have indicated both options, USCIS has retained.”
anyone here with the same status? and please explain to me what should I need to do? or any action should I make? thank you

if you are out of the country, you will have to file form I824 to state that you're doing consulate processing

you cannot apply both inside and outside the U.S. Someone messed up the application and most likely it will be delayed. as previous writer stated it has to be corrected

@KJ ML the petitioner needs to file form I824. I think the fee is $465. That's the same thing that happened to my son's case and I had to file that form luckily it only took 44days to be approved
