Not sure how long the security check lasts
Hi All, I been following with congressman since Oct 2023 to see where USCIS is standing after my interview completed in July 2023. I did responded to Medical RFE in Oct 2023. Yesterday USCIS responded as mentioned below: we are waiting for the results of the required security checks on your case before we can continue our review. All applicants for a U.S. immigration benefit are subject to criminal and national security background checks to ensure they are eligible for that benefit. Most cases proceed without an issue. However, due to both the volume of security checks USCIS conducts, and the need to ensure that each applicant is thoroughly screened, some delays on individual applications are inevitable USCIS asked me to wait for another 90 days before next enquiry. I already done with the waiting game. can anyone shed some light on my case and let me know based on your knowledge, Still how much time does USCIS take to approve my case.

Background check can take 6-12 weeks in the average. Sometimes can take longer depending on your country of origin. Some background can begin from the I-140 stage. Wait it out!

@Mr Green thank you for ur response. I am from India, and my i-140 got approved in 2012. my i-485 dates got current in 10/2021. I applied i-485 in 11/2021. Received AP Combo card 5/2022. interview scheduled in 7/23. RFE issued 9/23. since 10/23 they stopped working on my case.

@Mr Green hi Mr Green ! I’m still desperately waiting for approval :((( my block is MSC2390389XXX, PD October 07 2022, this have been current for almost 3,5 months… still in CRP since begging of August 2023. Emma says case is in NBC process normally , last agent I contacted said my case was reviewed lastly by an officer on 03/25/2024… do you have any predictions for me , any ideas when may I expect any updates ? thank you !

@D A I think you might be closer to getting a decision, hopefully in the coming weeks. CRP cases around October PD are now seeing the light. hang in there.

@Mr Green thank you for hope you gave me 🙏🏼 what makes me sad , in my block they almost stopped to work with CRP , 3-5 approvals per week , and still there are 196 CRP cases pending :( anyways , hoping for better !

@D A sometimes security check is due to very common name and they mixed up your name with some list of people that concern the national security but don’t worry they will clear it as soon as possible. do you have genetic common name ? or any prior criminal / speed ticket citation cases etc

@Y J thank you for your support ! neither me, nor my spouse have criminal records or even speed tickets. my first name is generic , but last name is not. husband’s last name may be a bit generic for a Brazilian…. I really don’t know 🤷‍♀️

@D A , I had couple of speeding tickets that were 10 yrs old. Officef during interview asked me if these are just traffic tickets and nothing else.

@D A the interview went smooth, and lasted 40 mins scheduled in Houston, TX. Mostly asking yes or no questions.

@D A I took around 8 yrs tax returns but they did not asked any. They asked passport, employer letter, ID, Visa copy.

@D A I usually took all the copies that I applied with i-485. Before I entered officers room, the officer placed all my docs ready to go over.

@D A I am not sure if I am falling under 2023-2024 visa number allocation quota. my PD is 2011 Nov

@Ven d I am trying to understand this visa allocation you mentioned. I would think that if your PD is way before the current final action date such as yours that is even in 2011, you are current - well, considering ROW and also for Indian China etc, I would think of anyone has filed and interview, they are mostly current before the could file the i485… so not sure what you meant by visa allocation, as I think they should have visa allocation for you before you file, at least for date of filling being used and if considering final action date, the fact that they are reviewing your application means that your PD is current.

Also you can sue USCIS for a delayed case on your own, you will get a decision within 60 days. Do youtube search to learn more about it, and to get assistance with it "Writ of Mandamus Pro Se"

@undefined null while uscis gave me RFE, they mentioned that if I don't respond by Sep 15th, 2023 than they will not include me in this year quota. I came to know about RFE in Oct 2023.

@Ven d that’s interesting, based on what I understand, uscis fiscal year 2024 is running of period “oct 2023 - sept 2024. your PD is current (nov 2012) and you should able to get a slot in fiscal year 2024. I think what the office told you during 2023 if you did not reply by sept 15 2023, you won’t fall into quota of fiscal year 2023 which is ( oct 2022 - sept 2023) , but now you will be falling into fiscal year 2024 ( oct 2023-sept 2024)

Typically, when you receive a medical RFE in September and respond before September 30th, your green card is approved before the fiscal year ends. This is done to allocate as many available green cards as possible for that fiscal year. In my case, I needed to respond to my RFE (Medical) before September 15th and received approval on September 23rd.

@George M Glad you received GC approval. I am one of the unlucky person who did not received notification on RFE. USCIS failed to update me and i some how able to find the RFE via congressman.
