what’s the reason stated for NOIR?

I asked the lawyer , they haven’t clarified me yet. one time they told me that my sponsor pulled out I-140.

NOIR is specifically related to the sponsor so I guess that might be the issue. I hope everything goes well.

What kind of document they requested?

paychecks , medical reports / doctors note.

Since you finished the contract for sponsor, how could they withdraw your I-140 since it has been more than 180 days?

maybe they are just telling me so that I could not leave. they haven’t told me anything atm , but I’ve asked BDV to port my job.

This is really frustrating I can’t stand the manager and the whole working environment, already left the job and told BDV to port the job . I completed my contract , I wonder why can’t I leave and find another job elsewhere .

@eb3 unskilled I haven’t consult with diff attorney. I think ur case status will update accordingly if u get NOIR. look up similar case on reddit and Facebook groups. bdv is known for threatening i-140 withdrawl.

@G C I heard same about their threatening. My case didn’t get change nor I get any update through mail. In contrary, I got the case update as CRP on July 1st. So, I was thinking why I didn’t get the NOIR update but the CRP.

if your i140, i485 was deny, you just apply a new one in 180days then you will be fine. PD keep the same with the old LC. If i140 was approved less 180days, sponsor can revoke it, but over 180days it does not a matter or affect your i485. Dont worry. I have a friend his case was deny i140 and i485 then he apply a new one; after 2month he got i140 approved.

I-485 filed - 02/24/2022 i140 approved - 03/11/2022 just got message from envoy that I will misrepresent my status if I leave the job so it’s not advisable. I already told her I finished my year as per contract and already left job last week.

I don’t understand what happen with BDV lately. Sponsor can’t withdraw your I140 or either I485 when I485 is pendind over 180 days and I140 approved. Make sure you keep your message and the emails with BDV and Sponsor for the future used. You better contact BDV again because the lawyer is on the employer side, not us. Wish you the best.

@Gc 0321 that’s my point about the 180 days rule. Envoy wants me to continue where I just quit, this is really messed up, looking for another lawyer now.

I think the reason is because the date you submitted your I485 is after the cut off date is Feb 01,2022. BDV submitted your I485 after that date so USCIS denied it. I have a friend also recieved that because they submit her 485 after Feb 1,2022

@Amy Nieee is right! my friend got NOIR too, since envoy sent it after the pd was current so USCIS can deny your case since its late. I have the same problem and just received the email from envoy telling me to keep my status after months of saying I need to move to work!

@Aiden Jose did envoy get back to you? my friend sent a request to open the case and USCIS also denied it. Envoy told her to go back to her original country and switch to AOS. If you still have F1, its good to maintain it instead of working

@Amy Nieee I have raised this very concern with them since day 1, and I didn’t move to work for the sponsor yet! I am still working on my OPT, so I am planning to apply to a CC college after my OPT to keep my F1 until it gets back to my PD, BDV is now ok with it since too many people got NOIR. they now asked my friend to get out of the US and start a conselor process which is bullshit!

while talking to USCIS Emma Chat, the live agent told me there was no any NOIR attached to my receipt number, if it was I would get notified by mail. it’s been 3 months that the lawyer told me that I got NOIR , no any mail yet . @Amy Nieee USCIS agent told me that my i485 has been filed. also talked with outside lawyer , got the same reply that i485 is filed.

I talked with BDV and they asked me to talk to HR about taking a temporary leave if they can allow me some time off. but they are negative on changing the sponsor. I have no idea what this is all about. can they do that ? kinda threat ? what y’all say about this

@eb3 unskilled Seems like they are trying to force you to keep working for employer. I read in another group post that some sponsors actual pay them a fee when you keep working for them. They also wanted those clients to keep working after 1 year up too and said they will withdraw i-140 as a threat. if there is no record of NOIR, then ignore BDV.

if you check with Emma and find out there is no NOIR, make sure to save all the conversation with BDV. You can cover your ass with those because you can actually sue them for falsifying information and used it as a threat. Just in case when you want to leave and they want to make it a big deal.

@eb3 unskilled No, they cannot do anything. What you can do is work once a week for the employer (if you want) but BDV has no right to threaten you that you misrepensented because you have shown no evidence of that. The contract was for one year so they need to shut up. You paid BDV and not them paying you, so you are not a slave. They can’t do anything. it’s all threat.

@Mrs Mrs I already left the job, they kept pressuring me to continue. I am going to port the job anyway now.

@eb3 unskilled That’s great you already left. They want you to keep working because I read from others in your situation that they get paid by the sponsors.

I take that back , actually Envoy told me that my employer may file a complaint that I misrepresented by not continue while I am waiting for reply from USCIS about NOIR. I asked them to provide me the official letter but they told me they can’t go into details because it’s the property of the employer. I am thinking if there is anything issued under my name, I should be notified by official letter(that’s my right to know) isn’t it?
