@i d you should call USCIS, and inquire about that. it’s unusual. however I heard many attorneys say that they don’t trust the uscis case tracker portal

@maria what’s your field office? and where are from (country)? usually uscis has 120 days to decide a case, after that you can threaten them that you are going to sue (need an attorney). meanwhile do a congressional inquiry.

no, what I mean is threaten them that you are going to sue, that usually helps. Jim hacking says that they usually start working on your case after that. and in any case they can not just deny you case for nothing if you have a solid case it’ll work.

what did you do to get approved ? congrats !! what do you say it was complex?

I mean it was complex in terms of my eligibility to adjust status, my application took 111 days after interview to be approved

well I did contact my congressman so he did an inquiry

So after the inquiry they responded ?

yes they did just replied that the Acknowledged that my application for approching outside normal processing time and that they still processing my application (I think they used a template)

so the inquiry didn’t help much tho ? did they said you are waiting on background check ?

I mean Marìa each case is different, they are many ways to create a strategy in order to ensure your case gets back on track, my case was expected to be delay since it was complex but when you do an inquiry it usually helps to get your case moving. I’ve seen attorneys write a letter to the field office director. at the end of the day you don’t want to bug them a lot because then they are going to rush your case and deny it.

but i heard after the processing time is over if they don’t respond , you’ll have to sue them

I mean you could try to sue them, however the 120 days is for N-400 applications, and even if you sue them which will cost you money (4K-5k) it doesn’t mean you will get a favorable outcome. before you even try to sue them you have to try the steps previously mentioned.

I didn’t do anything besides two inquires but a long time ago , I took my by surprise as well !

my interview was Feb last year And my last inquiry was on Dec in which they said they didn’t know how long I needed to keep waiting
