New Rule from USCIS for i485
Just saw on the news today that USCIS brought up a new rule says that if you come to US with a tourist visa/ student or with a temporary visa and applied for change of status you’ll need to return to your country until you get the approval.
do you all think it will effect us? I am in the Usa for 6 years now and came with a tourist visa. Then applied for Vawa, If they want us to go back, what happens to the car loans, apt leases or mortgages that we have? how do we pay them if we are waiting outside.
please note if you all know anything about this.

the nuances to this rule is a lot. one thing I know is it will be challenged. even attorneys are having a hard time understanding this rule as it does not say going forward. it’s a bogus and an open statement. let’s wait for immigration attorneys to address this.

I saw the same news briefing & it was a bit confusing. However, upon further research, I found out that VAWA cases are protected at the Congressional level while this “new rule” is coming from executives from within USCIS itself. It’s just so much going on right now, just stay in prayer & keep up with immigration news.

i have not gotten any updates from my lawyer but one of my friends just texted me and her lawyer said this does not apply to the current applicants only for the new applications.

This is the response from my attorney and I am from a banned country. read below:
Your case is on hold with USCIS because Nigeria is one of 39 countries subject to a USCIS adjudications pause.
In addition, USCIS issued a new Policy Memorandum on May 21, 2026, announcing its intention to require green card applicants to return to their home countries for consular processing through the U.S. Department of State, while limiting adjustment of status within the United States to cases qualifying for “extraordinary relief.”
We believe this policy is inconsistent with longstanding legal authority and Congressional intent, and we will continue to closely monitor the anticipated legal challenges. At this time, it is premature to assess the potential impact, if any, of this policy change. Please check back for future updates as additional information becomes available.
So at this time, we do not believe any action or proactive communication with USCIS is needed. I anticipate that this policy will be litigated and found to be inconsistent with our immigration laws.

It shouldn't affect people that already applied and waiting so long , because it doesht make sense if applies. News wants to sell and wants to make people press the links spreading terrorism and is a memorial weekend where all offices are closed, imagine the confusion. if it is like this then we just leave everything and abandon everything and take our families and dogs and never look back
but no is not going to be the case , it makes sense to be a rule for new applicants and people less than a year or 2 in the states ,but people who already build a life and have their working visas and everything while waiting it doesht make sense why to leave ,employers needs them, they are part of what makes America great.

I think that targeting tourists coming to attend world cup for soccer in usa next month cause many of them want to stay after world cup it's not affecting humanitarian cases like Vawa,U Visa, T Visa and asylum.

The "new rule" does not affect DACA, VAWA, U or T Visas because we have differed action by default, now extraordinary relief? We all have extraordinary circumstances, we have families, jobs and years of life here people! Don't let USCIS intimidate you like always, no matter how many obstacles we encounter, we came here to stay, it is our right and we well deserve it! Let's not give up, keep pushing forward! it’s not a right to be an American it’s a privledge. just because you are here does not give you a right. all must follow the laws and rules. you break the law, you leave easy enough
