@Maria Tello when did your first I-140 get denied? do you have any nonimmigrant visa?

@Maria Tello I'm asking about your denial. usually if I-140 gets denied your I-485 gets denied in 2-3 months. So I wonder if this is a case in your situation. if it's the case you should leave the US and do consular processing instead of AOS. have you filed your second I-140 with an attorney?

@N F yes, the denial was 2 Months ago I haven’t received denial for the I-485 yet but I think I will eventually, on the other hand yes I applied for the new I-140 with an attorney.

@Maria Tello have you talked with your attorney regarding your denied petition? I believe only option you have is to leave the country and do consular processing. as soon as you receive I-485 denial you will accrue unlawfully presence for all the time your I-485 was pending. (it's a ban for 10 years) if you leave while your I-485 pending you'll not accrue that time.

you do not have to leave Country! when you filed your second case. you had a new I-485. now your priority date is with your second case!

thank you John, my concern is that my work authorization is going to expire on March 2024 and my priority date it’s not current to file for my i-485 and don’t want to be out of status.

@John Aliyev what do you mean by second I-485? do you think @Maria Tello filed new I-485 when the VB is not moving from July 2022 last 3-5 months? @Maria Tello you can apply for ead renewal based on your current pending I-485. you don't have to wait to file new one.

Maria I'm in a similar situation. my I140 was denied a year ago and I applied for reopen I290b. but I already received 2 RFEs from I485 and have done biometrics. my work permit expires in August 2024. I believe you should renew EAD now because USCIS is too slow.

@N F can I do that even though my first I-140 was denied?? because that’s what I would love to do but I was afraid the renewal was going to be denied because of the first I-140.

@Maria Tello you can do it. ead is based on pending I-485 not I-140. if it gets denied your new ead gets annulled. you can file I-290b for denied I-140 and win some time. and then decide if you're gonna do a consular processing or there will be new option for you.

@N F I already filed an I-290 B and was dismissed, I just talked to my lawyer and I am considering go back to school and get a student visa while I wait for my priority date this is so frustrating because I have a great Job at DC Government right now and I didn’t want to loose my Job 😢😢.
