"New Card Is Being Produced" on my I-360 (not C31 or C09) – Is this VAWA approval or just my C09 EAD?
Hi everyone,
I'm trying to understand a recent USCIS update and would appreciate hearing from anyone who has experienced the same thing.
My timeline:
VAWA (I-360): Filed February 22, 2022 (EAC/Vermont)
I-485 & C31 EAD: Filed June 2022
C09 EAD: Filed April 2, 2025
Congressional inquiry and expedite request approved.
Biometrics completed on May 1, 2026.
USCIS issued an RFE on my I-360.
I responded, and on June 2, 2026, the status changed to "Response to USCIS' Request for Evidence Was Received."
Yesterday my statuses changed to:
I-360 (EAC): New Card Is Being Produced
C09 (IOE): USCIS is currently processing the case (same generic message)
C31 (separate receipt): Correspondence Was Received and USCIS Is Reviewing It
I-485: Case Transferred to Another Office
Lawfully marks the I-360 as "Approved" because it says "New Card Is Being Produced."
My questions:
Has anyone had "New Card Is Being Produced" appear on the I-360 receipt number instead of the C31 or C09?
Did it end up being VAWA approval with a C31 EAD, or was it actually just a C09 EAD approval?
If it was VAWA approval, how many days later did you receive the approval notice and the EAD?
I'd really appreciate hearing from anyone with a similar experience.

@John looks like they are still working on cases in march/ April. I see some June 2022 filers get approved. I received nothing so far not a single RFE. I filed in Oct 2022

@ endless it’s always recommended to wait until they send out RFEs before you send out the medical.

@Endless Battle I am a VAWA applicant and would appreciate some advice. I need to renew my Employment Authorization Document (EAD). I initially filed under the C31 category in June 2025, but I have not received any approval yet. Do you think I should submit a new Form I-765 under the C09 category instead? Has anyone been in a similar situation or have any advice to share? Thank you.

Hi @Dan Dan, I was in a very similar situation.
After filing my I-360, my attorney initially filed a C31 EAD. Later, I realized I also needed a C09 EAD based on my pending I-485 so I could work while my I-360 was still pending.
In April 2025, I filed for the C09 EAD and waited about 14 months without any progress. I then contacted my local congressional office, and they submitted an inquiry to USCIS on my behalf.
After that, USCIS issued an RFE and scheduled biometrics for my I-360. About 90 days later, my I-360 was approved after 52 months. However, my C09 case still has not moved.
Every case is different, but I wanted to share my experience in case it helps. I hope you receive good news soon. Wishing you all the best!
Yes, definitely you need C09 EAD while your i360 is pending since your case is from 2025 I assume.

Please everybody I need your help and I need an answer. I have a question and I have a little problem.. I got approved on my I 131 travel document so but the uscis made a mistake on my name and sometime they sent me a letter for barometric, whereby they already approved my travel documents, and they have already sent it. The travel document to me. Should I attend for the biometric. So today me and my lawyer call the uscis office Monday 27th . A lady picked up the call asked me my name every information she needed and she checked on her system so that the barometric was canceled by us so my lawyer told her that we did not cancel any biometric appointment so she was saying, maybe it might be mistake from the office, but it was not showing on her system that the mistake is from the office. He was showing that they the applicant council it so then she not gave me an advice that I should go for the barometric capturing that if I did not go they mine revoke it .so I should go there and tender my problem telling them about my name was not spelled correct . and my biometric appointment is on Wednesday 29. I just need you guys advice.
