New card is being produced
Hi everyone! Is it normal to get the approval only for the i-765 and not the i-131?

USCIS : To improve efficiency and reduce Form I-765 processing times for Form I-485 applicants, USCIS may decouple Forms I-765 from Forms I-131 filed at the same time. Effective Feb. 1, 2022, when possible, we will adjudicate an applicant's Form I-765 first. If we approve it, we will issue an Employment Authorization Document without any notation about advanced parole. We will adjudicate the Form I-131 separately and if we approve it, we will issue an advance parole document.

This is what AI has to say about your question. take with a grain of salt. (btw: I just got my i-765 approved in a EB-13, also with i-140, i-131 and i-485 pending as you) Yes, it is becoming increasingly common for USCIS to approve I-765 applications (Employment Authorization Document) separately from I-131 (Advance Parole), I-140 (Immigrant Petition for Alien Worker), and I-485 (Adjustment of Status) forms in EB-11 cases. This policy, in effect since February 1, 2022, aims to expedite EAD processing for applicants seeking work authorization while their main adjustment of status application is undergoing review. Here's why you might receive an I-765 approval first in an EB-11 case: Streamlining the process: Decoupling EAD adjudication allows USCIS to focus on eligibility for work authorization based on your pending I-485, potentially leading to faster processing times. Reducing backlog: The EB-11 category experiences high demand and significant backlogs. Processing EADs separately helps manage the workload and improves overall efficiency. Flexibility for applicants: You can start working legally while your green card application progresses, providing financial stability and reducing dependence on sponsorship during the wait. However, it's important to note that getting approved for I-765 does not guarantee approval for the other forms. Each application is reviewed independently based on its specific merits and supporting evidence. Here are some additional points to consider: Advance parole may still be reviewed later: While USCIS prioritizes EADs, they will eventually adjudicate your I-131 application separately. An approved I-765 does not pre-determine the outcome of your advance parole request. Stay informed about your case: Check the USCIS case status tracker regularly for updates on each form's progress. You can also consider contacting a qualified immigration attorney to understand your specific situation and potential timelines. Remember, the decoupling of I-765 from other forms is a relatively new policy. While it's becoming increasingly common in EB-11 cases, the specific processing timelines and procedures may evolve over time. Keep yourself informed and stay in touch with USCIS for updates on your individual case.
