Need Your Help 🚨
Can I filed for C9 category EAD if I don't have an I-94 ? I already filed a I-360, I-765, I-485 the lawyer who took my money and send back my documents have told me he filed C31 category which means my I-360 would have to be approved first. it's been over an year now but I haven't received not even a PF and it's 17 months now since I've filed. can anyone help me out on here?

yes you can apply EAD i765 under C09 category you also can apply Advance Parole i131. fill both form i765 and i131 and send to USCIS Nabraska With copy of your i360 and i485 receipt notice. no fees

nope, as long as you have a pending i-485 you can file C09

@my god is and awesome god 🙏🏾🙏🏾 you do have an i-94 and it's on the CBP website. To get it, go to the site and see the i-94 tab, put your information and click to generate it and print out. Then you can attach it to your i-765 form when you apply for your C09 EAD. Also lots of people in 2023 from my analysis did not get and are yet to get PF, so you don't have to worry as your i-360 is processing timely even without a PF. If there was something wrong with your petition it would have been rejected or you would have received an RFE by now but that does not mean you won't get an RFE later for "good moral conduct" or "medical".

@bridges 5 I did get a RFE for good moral character and criminal history from both Jamaica and New York where I'm now living. the reason why I don't think I can find a I-94 is because I've came here illegally after my now ex wife withdrew my I-130 and start divorce process without I even know what was the problem. so I entered illegally and I was living with her while I came she was supposed to let me get a PIP parole in place due to the fact that she's serving in the military but she refused to do it because she saying she didn't want me to come to America after she thought about it she only wanted to come visit with the same child she threatened me about not going to be able to see.

@my god is and awesome god 🙏🏾🙏🏾 I would advice you seek legal counsel in how to proceed as your situation is kinda complicated due to your entry, you won’t have an i-94 as you were not inspected into the US. However you marriage to her a US citizen and you filing for Vawa cuts you certain breaks but a lawyer would be in the best situation to help you navigate this if you don’t have one. You can pay a fee to have consultation after which you can proceed with a better choice highlighted for you. Best wishes!
