Need Help
hello, I am applying for student visa in US. the thing is that my uncle applied for our immigration in 2008 but our family has still not received it. also, my father passed away in Nov, 2021. my uncle says that the immigration won't be valid for us anymore. i'm worried if it will influence my visa status as student? can vo reject it on this basis? also, I am 26 already and already not eligible to immigrate with family even if my father was alive.

It all depends on the officer. My uncle also applied for my dad and he passed away before our interview making all of us ineligibility to come to the US. I later migrated on a visitor visa, but the officer never asked about my dads case. Just make sure that if asked do not lie. Tell them the truth and leave it up to them to decide. Do reiterate that petition isn’t valid anymore due to the passing away of your dad.
