need advice
have been married for 3 years and now my husband wants to divorce and he doesn’t want to do it through court. I want to go through court because we have almost 1 year old baby that I will need help with so I can work. please if someone went through the same situation I am going through it’s worth it going through court? I feel like I don’t have a choice because he won’t do anything to help with baby if he’s not told by court. will appreciate your input.

I think she means her husband doesn’t want to get officially divorced. He just wants to be seperated.

what is your status right now? If you have 2yr gc you can file divorce and remove the condition with or without him. If you havent started gc process you need to file it first and file divorce after. In cali theres uncontested divorce but if you need help with baby definitely go through court and you might need to talk to lawyer as well to make sure everything. Hope everything goes well!

@lala bingo The reason he's not going through the court system is that he would automatically be put on child support. And child support is not for the child like you guys think. It's a big business for the system. After the courts received their percentage from his wages, you get what you get. And if he doesn't have income for the system to collect child support payments, he gets fined, and if he's unable to pay, where he has accumulated backed-up child support payments, he goes to jail. Now, what good does that do for the child, or you for that matter? If he's employed, I would get a prepaid Visa card and see if he can add funds for the baby to help you with his child.

@Zora Jean Pierre he have a good paying job but he doesn’t believe in spending money on child which is the reason he doesn’t want to go to court because he believes his money belongs to him only. but he wants to be a dad and selfish at the same time

@lala bingo if you can prove the marriage was real and have enough evidence, you can remove the condition and renew the gc even after divorce. But he needs to goto the interview and has to cooperate! Or if there’s something like domestic violence involved or something I heard you can do it all by yourseld (vawa) but I would look for a lawyer who can take the case. Im pretty sure if you lived with your partner more than 2 years with solid evidence your gc will be fine. Divorce process could be long so make sure to check the timeline and get extension

@lala bingo sharing the timeline I found on the internet, its Cali case 2021 March Divorce filed 2021 July Submitted i-751, gc extension 24 months 2021 Sep Divorce finalized 2022 May RFE 2022 August RFE submitted 2022 Oct Fingerprint 2022 Nov Interview notice 2022 Dec interview/card I really hope this helped you and hope your case gets resolved soon!

@lala bingo His child is hardly a toddler, regardless if he doesn't believe in it or not, he still has to spend.🤦🏾‍♀️ Are u employed, either part-time or Full-time? Depends on the State, ofc I would go down the Food stamp office and apply for food stamps. And one thing I know if he is put on child support and he's in the system and doesn't pay, he'll lose that good-paying job.

@lala bingo I have some questions to ask u based on the information I found. How long before ur GC expired, did u enter the marriage in good faith? Can u provide proof, i.e. such as having joint property, bank accounts, tax returns, and affidavits from people who witnessed the marriage for those three years? Either way, u can adjust ur status by filing an I-751 petition for the removal of the GC's condition. Ur GC is a conditional GC.

@kitchen fam I have lot of evidence to prove our marriage was legit, everything is under our both names, we had two weddings too one in my country where he paid bride price and I have five signatures of people who witnessed our traditional wedding in my country. thank you so much for information you gave me! @Zora Jean Pierre am a part time employee, because am the only who takes care of the baby 24/7, my green card is expiring January next year.Yes our marriage was legitimate and I have lot of proof that we had legal marriage.. thank you so much for responding and giving me information. @lala bingo Then, I would advise u to petition for the I -751 before ur GC expires hun. Since ur current status is conditional, u can change it before or after the marriage is over. And back to the child support, it doesn't truly benefit the child. The system takes a huge percentage of it before u get anything for that child. I would also recommend that u and ur hubby stay on good terms if he decides to leave through or without the court's intervention, so that way u two can work together. I know most men purposely make themselves unavailable so the mother can be the sole physical caregiver stuck with the child when she has work, etc.
