N400 question about marital history
Does it matter if you were married and divorced in your own country before coming to US and marrying current spouse? what kind of background check do they do on that?

it’s safe to tell the truth & provide all marriage licenses & divorce certificates … don’t want to say never married & they find something else

please put everything on the form, my first marriage was in a different country I put that on the form and also sent evidence of divorce.

You must declare the info and have your divorce certificate with you in English or translated into English. It won’t affect your case that you were married and got a divorce as long as you have enough proof that your current marriage is legit.

thanks for replies @n a @bri flan @Johnny Walker yea current marriage totally legit and filing together. earlier marriage ended in divorce back in home country and I have original legit paperwork. will it matter that I was technically married when I left my country and got papers afterward?

as long as you never got married here to your now spouse while you were still married in our country . they see it as fraud & that your new marriage as not valid…. I’m not a lawyer tho please contact an immigration lawyer to relieve some stress or concerns. good luck 🍀

@bri flan did they ask you questions about it or do background check? I’m not concerned about anything but wondering how they use it to make the process or interview harder

@marriage-gc I-765 as soon as you divorced before your new marriage you're good. life happens. they won't make it harder for you. probably couple questions.

@N F great! they never asked my marital status during my visa interview when I first came here. that time my divorce was pending so I had written married in the visa. and I got papers after the interview. I didn’t intentionally distort any information ever. but do you think they will bring it up in the interview?

as long as you were divorced before you got married. they don’t care. Even if you were married 4/5 times before. as long as you were divorced at the time of your current marriage , that’s all that matters to them. Have your docs to show that at your interview. no issues.

it won’t matter if you got your divorce papers after you came. You might be asked about it. just tell the truth. They understand that life happens.

@marriage-gc I-765 they asked me nothing regarding that I've been divorced years ago...but I did add everything even for my husband who has been divorced 24yrs ago. A friend of my though was married in in our country of birth and was asked a whole bunch of questions about it.
