u need to amend ur taxes otherwise they ll denied ur case amend ur taxes n file jointly cz i did the same thing n they denied ma case i waste money n 1.5 year fr whole process

you have a tax preparer, they can file a joint tax to amend the first.

no I did the same I filed together first time then after that it was married but filing separate and now I’m a citizen so it’s not an issue

If married, you can file separately or file jointly. But you cannot file single when married. Contact the tax preparer and ask him or her on how to amend your tax. I hope your husband did not file as single also?

@maria lopez , have your tax preparer amend that return for it to say MARRIED FILING SEPARATE. if you are filing based on 3 year rule, you need last 3 yrs of tax returns. if they see single on any on those, they will consider that fraud and deny you. do that before submitting N400. Amendments need to be mailed so it will take a month to process. do not waste your money before this
