My wife got 2 years Green card instead of 10
i did EB-3 unskilled and got approved and got 10 years green card
initially when i filed i-140 i-485 i-765 I haven’t added my wife because i haven’t married yet
i added her later before i-485 approval
i got approved after 5 months filing for my wife
and my wife got approved on July
but we got for my wife 2 years Green card with CX6 type
Usually dependents of EB-3 get 10 years green card
on her approval notice its written based on approved I-140
is anybody had this issue before
please advise

Hi. As far as I know, your spouse gets a 10 years green card only if you have been married for at least 2 years. Is that the case? I don’t know if there are different rules depending on the type of green card though.

when you filed initially, you were not married, therefore she was not your spouse at that point and was later legally married to you. so, if you guys have been married for less than 2 years, which I’m guessing is the case in your situation then yes, she would have gotten a 2 year gc.
