My shocking experience with CBP officers at Los Angeles airport
I flew to my country for a month on a VAWA based advance parole. Yesterday, I landed back at Los Angeles airport.
I am just shocked that CBP officers could do something like that to someone.
I was was told ‘you need to go back to your country’ by a CBP officer. There were 4 officers involved in this whole thing. They questioned me for 6 hours and used all kinds of racist & derogatory language during the 6 hours. One told me, ‘We don’t fucking care what happened with you (VAWA) - yes they used the word ‘fucking’
I was told, ‘We are going to charge you with sex trafficking if you don’t do what we say’, I was told ‘Don’t worry, we will make sure you don’t get your i485 approved’
They used all kinds of demeaning & highly offensive language during those 6 hours. I can’t explain in words how I felt. This has traumatized me to a level that will take me years to recover. What’s worse is those officers were Mexicans.

tbh I think you really exaggerated the whole story. because they their supervisors who won’t let them do whatever they want and there’s a cameras with audio sounds recording.

and you here back, If they wouldn’t want you they would refuse your entry and they definitely can it’s says on the bottom of your advance parole.

@nkr tt Exaggeration? Brother, the room they were questioning me was just next to the room with the supervisor with the door open. Those officers had to ask their supervisors whether they can question me. That supervisor came out of his office and asked the officers, ‘Is this the guy’ pointing a finger at me. You think I am lying? I wrote this honestly just to warn other applicants what you could get into.

@nkr tt They can’t refuse entry because it’s VAWA, it’s what my lawyer said. That’s the only reason I traveled. I was prepared to wait for another 4-5 years for this process without traveling.

well, sorry that happened to you, but it doesn’t surprise me. I know more stories like yours. that’s why I always encourage people to use advance parole ONLY in emergency. My mom passed away 2 years ago, and I didn’t use my advance parole to go to my country for funeral, because unfortunately CBP do whatever they want.

@Just Hopeless so what I mean is you trough the advance parole it’s say that all case even though uscis approve you advance parole CBP officer may still refuse you to parole into USA. like I said brother not all layers knows that even if you Vawa pending even if you have pending adjustment status here it doesn’t matter. first of you got you advance parole based on pending I-485. it got nothing to do with your Vawa. Now if your 485 would be approved and you was a green card holder he can’t refuse you enter no matter what. only Judge can take green card away. but any other visas or pending adjustment didn’t guarantee your entry. ask other lawyers.

@nkr tt My EAD-AP combo is C31 category, which is VAWA based. Once I VAWA is approved, I will apply for C09 category, which is i485 based. CBP cannot refuse entry to VAWA applicants, it’s the law.

I was traveling from Florida to New York. an officer told me your ead card would be expired in 6 months and held me in the line. I told him can you renew it here today for me?
I have a passport and driver's license; if my work permit expires, I will use them. His as$ was blacker than mine.

@survivor p My lawyer said they cannot deny you entry if you’re a VAWA applicant. And with the experience I had yesterday, I totally believe him. If it wasn’t for laws, they wouldn’t had allowed me to enter the country, that I am 100% sure of.

@Just Hopeless I’m deeply sorry this happened to you. it just comes to show you that anything is possible upon returning to the states. I myself traveled to Mexico for two weeks for the first time on AP. my return flight is this Friday. I’m preparing myself for the worst.

@survivor p I don’t know what law this is. I am just repeating what the lawyer told me. It’s a well known lawyer in Los Angeles. The only reason I traveled because he told me since you’re a genuine VAWA applicant, they will have to let you in, no matter what.

@gigi kmn They took my phone away in the room. I told my lawyer everything & he was willing to pursue it further for an additional $3000. I am still thinking if it’s worth it. From what I have looked online, the probability of them being held accountable by the CBP is zero.

I agree with @nkr tt. He is exaggerating the situation. I have travelled 21 times since I received my advance praole. I never had a bad experience with CBP officers. @Just Hopeless have something in his records that he’s not telling on this forum.
Also, I think he is lying as C31 will never give you advance parole.
Advance Parole is based of C9 and not C31.

@A T Let’s agree for a moment that I am exaggerating. What about the tons of people just on this post that seem to have the same experience or know someone that has had the same experience. Are they all exaggerating too? My record is very clear - came legally to the US by flight, no criminal records in the US or my country.
I have C09 on my current combo card. I had C31 when I received only the EAD. Both are still valid. My mistake.

@blessed & favored My VAWA is still pending as explained in the comments already. AOS could still be denied, absolutely, even with an approved VAWA. AOS is a whole different thing, a different process. CBP cannot deport you from the airport if you’re a VAWA applicant as long as your background is clear & there’s no denial of AOS already. There are different types of AOS, I am sure you know. Like if it was a AOS related to work permit or other category, you could be sent back but VAWA applicants cannot be sent back.

This is the same thing as when an unethical cop pulls you over, he can either give you a hard time or not. depending on you respond to their aggression, they can certainly take action by arresting you and charging you. If you hold your ground, they will let you go.

This can happen 1 in 10000 but, yes, it can happen. I have heard stories from that little room. While I had a had a general good experience coming back, I don’t doubt you.
I think you should have asked about your lawyer when they started to question you though.

@Carla S I did. I said I want to talk to my lawyer before talking to you. They said, ‘The only things we cannot stop your access from is phone calls (to family only through their landline only), food & water & bathroom’. We are not going to let you talk to your lawyer.

I believe you something similar happened to me in Miami Florida coming back from a cruise with my combo card(vawa pending) they were very rude trying to intimidate me asking me questions it was very bad experience and also returning back from my country(Honduras) they checked my bags and also asked me a lot of questions and checking my driving license it was horrible experience 🙂↕️ the best experience was JFK AIRPORT IN NEW YORK NO QUESTIONS AND ALMOST NO WAIT

lawyer’s always warn us not to travel unless it’s an emergency.Immigration has a right to allow or deny you entry . just like a visa they have the right to allow you or not . ….. it’s normal, don’t feel sad 😢 what is important is that they can’t control uscis ‘s decision

@Just Hopeless I just arrived home from 16 days traveling abroad in my home country in Mexico. Upon arrival they took my biometrics and the officer said to wait in secondary for my name to be called. within 5min an officer called my name and handed me my passport while telling me that I’m free to go. no questions asked.

I believe you. I have been in that room with those officers at LAX two years ago when I was entering with my student visa, it was so traumatic, what I witnessed there and how they talk to people… how abusive they are.., that’s why I’m not using my advanced parole now.
