my I485 was approved!
After they wrongfully denied my case on June 2023 (1 st denial notice for the I485) and July 2023 (was the 2nd denied of my I485 but this time we sent a letter to the offices in NYC and they updated my case with a second denial notice š„ø) check timeline:
@June 23,2023 we sent I290 a motion to Reopen the case. + $625.00 money order.
@ June 29,2023 ::: I290 was received
@ July 29,2023 ::: Case was reopen and I-765 was reinstalled (work permit)
@September 7,2023 :: working on the case
@ September 28,2023::: case was approved
not interview was required and my medical probably was found šā¦.
always make a copy and screenshot of all the updates on the page (Uscis website) if need any help Iām gladly open to help anyone.

I was very upset and I was ready to go and claim my rights in front of Federal P building if they did not approve and deny the case, I was ready to attract the attention of the press; I have my job but see how we pay taxes, comply with the law, invest here and they delay my case for a mistake made by them.. no way!!!!! now I can move on on other things was on Pause⦠hope everyone could have good news very soon

@mafalda diaz I have the same issue. Tell me please, they denied your 485 because they told you didnāt submit medical (of course they lost it)? What did you send them with your I290b? Because we provided tracking number and copy of my medical. It was in July. By now I do not have any response from them.

@Lana p hello Lana, I feel you!!! when we sent our documents (I-130 my husband and my Medical exam) both were sent and pay together and that help us a lot because I-130 was approved and my they said I never sent my documents but my proof was the receipt containing both REF in one receipt paid with the same Credit card and the tracking number showed both were receivedā¦.
for the I-290 my cousin sheās my lawyer (made two letters one for the director of federal plaza and the other for the office whne my papers need to be send explaining the case by timeline

Hi @mafalda diaz . Iām waiting for my I290B decision too. My I485 denied by a mistake because they said I didnāt submit medical which I did. However , when you receive the I290B letter -case reopened, do they tell you that ā Ead is reinstatedā? I know on the I485 denied letter tell us have to return the EAD to the nearest FO, but I still keep the EAD WITHOUT USING IT. Can you please share your experience!

hello @Gc 0321 in the letter I received they never requested my EAD. but also you could send a letter to the officer who denial yours, mine was MRS quintana and we sent letter to both office (federal plaza and another with our I290b)

Hi@mafalda diaz @Mr. Wilson Did you guys write the letter to explain the situation that Uscis denied I485 by the mistakes?
I have my I290B receipt # and Itās been 4 months without update. On the I485 Denied letter, I didnāt see who or the ID # who denied my case, that why I donāt know how to write the letter to the two offices that @mafalda diaz mentioned above!
Iāve asked my lawyer āCan we write the letter to send to the office where my case is got Denied?ā, but the lawyer said it maybe not work or canāt reach the Officer.
Please give me the deatails how you work on your I290B cases! I canāt go to work or anything but waiting, Iām running out my savingš

@Mr. Wilson what did you sent? they just denied my i485 after waiting exactly 2 year because they said they did not received my medical. I am not sure of what to send them. I asked my doctor for a sealed examan and they do give them out for $35 with re signature, but I am afraid if I send it again they will say they never got it in the first time. please help

@angie Antunes first question do you have a lawyer ? secondly have you sought congressional help ? the reason being that they may be able to contact the local field office on your behalf and push your evidence of submitting the medicals through for you and hopefully force them to change the decision . The most important thing is to also file the motion to reopen your case whilst you explore these options . As you already know these people are looking for any reason to deny cases and sometimes when it gets denied and you donāt take immediate action it could result in that denial being final . Reach out to your congress man /woman asap and present them with the facts and have them contact the local field office ,I will start from there if I was you .
my case was different ,the congress was already helping me with my case and they were aware that we never got a letter to appear for an interview so when they denied us based on that ,they took it on themselves to proof to the local field office that we never got any letter but I did file the i290 regardless and paid that money which I never got back lol but at least my case was reopened almost 2 to 3 weeks after it was denied

@Mr. Wilson Yes my congressman office was already helping me because it was taking 2 years for their decision and needed ny green card. they were the ones to actually let me know that my case was denied.

@angie Antunes so stay on top of them ,you need to file the motion whilst you stay on top of the congress . Do you have any evidence of mailing in your medicals ?

@Mr. Wilson yes I do. I send other evidence in the same package, like passport and birth certificate but they said they are only missing my medical exam that was in the samee package all together. sooo frustrating
