My friends I-485 got denied
Hi everyone has any one being denied or knows who have being denied, before 1-485 marriage based, the notice of action does it come with options of what he or she can do ?

I think you cannot appeal against the decision. however you can apply and send in a fresh one.

yeah we filed with the wrong fee. the notice said you have 33 days to either leave the country or refile

@K C I'm not being funny but there is no way you can be given 33 days for fee filing. impossible. they can always send back to you to enclose the correct amount. Am sorry but that makes no sense. Noone has ever been asked to leave the USA for that mistake.

you got a read the letter frist , they wont give you deportation notice for the sending incorrect amount

tell your friend to check their uscis account to see what the letter says if did they upload it to the account

no wrong fee will result in rejection not deportable, their is more to that.

It’s either the petitioner withdraw the case without telling the beneficiary or there’s an inadmissible account which could be he or she lied on the form! when we come here, let’s say the truth so that others can learn from our mistakes or information.

They won’t tell you to refile, it’s an appeal process where you will have to appear before the board of appeal and tell them why you should not be deported or leave voluntarily.
