Did u received an RFE? Not all lawyers are good and expects when it comes to VAWA. Some lawyers are just there to see u fail. there’s a lawyer in Worcester- MA. Bethel Law, she’s extremely good and I mean very very good. you can look her up and I know for sure, she can help and she isn’t going to take that crazy amount from u. this is ridiculous. How and why are they charging you to appeal again? smh

If your initial 485 got the denial and after you filed VaWa and submit 485 along with it maybe you were out of status for a while? @B A

@Amber Bergamot I submitted affidavit from from friends and families for the rfe that’s it that’s all the lawyer submitted but I don’t know if that was the reason for denial though

Sorry to hear about that, I believe the reason is the late RFE response. The deadline is 87 days and your response was 92 days.

What did you submit in your initial package for good faith marriage? Do you have what was submitted to USCIS? Were you in removal when you got married? Also, if USCIS received your RFE response late, that could be grounds for denial. You could find a VAWA nonprofit in your area to help you with your appeal.

@i’ll be happy @Beetle Juice it states I did not proof enough evidence of residing together with the spouse since I was not on the lease. also not good faith marriage and some inconsistency in my self affidavit and supplemental affidavit. in all my lawyer didn’t do due diligence and screwed me up

no shared residence is a huge red flag. did you have a joint bank account at least? also the marraige is less than 1 year so I’m assuming no join tax returns? these are classic mistakes they want people to make.
