my asylum case Decision was pending for last three years. Afterwards case status changed in to fees waived and new card has been produced. A week later received EAD card with A05 in approved category
2.5 months later status changed in decision was mailed and it was referred to court why? any one have any advice please.

@sam Sam then you are in court system and your A05 is no longer calid. you have couple of options here that i can see, but get a lawyer because pretty soon you will get a Master hearing and ykur situation is not ordinary. options: 1.Contact USCIS and request your i-94 which they will make an infopass appointment for you where you can double check your status or they will call you and let you know that you were denied and now you are in court. 2.Contact OPLA(DHS) you can google that info and ask them, wtf is going on and why are you in court system wince your case was approved and you got an EAD based of asylum grant. 3.Contact your Judge’s clerk,if you got a judge already, and let him know about the situation and wtf is going on. 4.Schedule your Master Hearing and again you will have to out , wtf is going on. all these options can be done without a lawyer, but at this point your status is at stake, so don’t play with it. also usually when you are reffered to EOIR you have a Judge and Master Hearing date, if so, google EOIR judge clerk info and you can email them and ask for the clarification

@i l thank you so much for your guidance. I have already an attorney through out my case. He is also very surprised that wtf is going. USCIS is not reponding at all. Mater hearing is scheduled for next year but it’s shows a visiting judge.

@R R you have to go to SSA and they will uodate you with your A5 EAD @sam Sam there is an error. the question is,is it an error that they approved you or is it an errors that they denied you. try to set up infopass for i-94 . also people say you can try to find your i-94 online,but i dont think it works for asylum granted.

@R R it’s was pending decision then after an year changed to application is pending then again went back to decision pending. Then after 2 years it’s changed to fees waived. I feel that application pending is when they open it and review it.

@sam Sam : Unfortunately, receiving an A05 EAD does not always mean the asylum was granted — sometimes it’s a system glitch, or the category gets issued in error during the transition to court. The only way to confirm your actual status is through a formal approval notice and I-94 from USCIS. (The I-94 comes stapled to the approval notice from USCIS.) If your A-number is showing up in EOIR (immigration court) and your USCIS status says “referred to court,” that means your case was not granted and has now shifted to the defensive process. This happens when USCIS doesn’t approve your case and refers it to an immigration judge instead. At this point, it’s really important to: 1. Consult a licensed immigration attorney right away — especially one who handles court cases. 2. Verify the source of the A05 card (contact USCIS) — the card may have been issued mistakenly or as a result of overlapping actions. 3. Request a full FOIA (Freedom of Information Act) copy of your asylum file from USCIS to see what happened internally. Don’t rely on case status alone — these systems can be inconsistent. Only the actual paperwork you receive will confirm whether asylum was granted or referred. Wishing you best of luck moving forward.

@Lilo Pelekai I know only A05 doesn’t always means an approval but I also received a denial letter for my EAD renewal application. They mentioned the reason that they reviewed our file in USCIS and it’s shows that we have already granted asylee status. So we are no longer eligible for EAD in pending category c08.

@sam Sam: Indeed, it's very confusing. I suggest you get an immigration attorney. Without the approval notice and I-94, but the referral to court, you're in immigration court. Please, get with an immigration attorney, as the immigration court is very different from USCIS. There, there's actually someone whose sole job is to prove to the government that you deserve to be deported. And I'm not joking. Getting an immigration lawyer would help you sort out this confusion. And you want it sorted out before you step into that court, else it will more likely also play against you.

@Lilo Pelekai I have a immigration lawyer through out my case. He is also very confused and hasn’t seen this in his all career. He is trying to figure out but the problem is USCIS isn’t responding at all. He is not telling us what actually happened with the case. I am also very worried and looking advices.

@sam Sam It's good that you have a lawyer. It's bad that he is not getting answers. In this case, you guys should be prepping for court now. At this point, asylum is your defense against deportation. Your lawyer and you should prioritize this one, and bring the denial of the C08 EAD as a reason for the A05 EAD being sent instead. If USCIS' response on that is documented, then that can be used as the government being confused itself by making the argument that you got granted asylum but then referred to court. If that communication was verbal and there's no record of it, then your lawyer will use another strategy. But you guys need to prepare because now it's a trial of you. I'll share a post shortly about defensive asylum, as it's a bit lengthy to put here as a response. 😕
