question Urgent i-485 plus I-765
Hi everyone! Help with this question.
I’m from Venezuela and have a pending EB-2 NIW I-140. Since my priority date is current, I'm planning to file my I-485 and I-765. Will USCIS process and send the I-765 (EAD) even while the I-140 is still pending?
How many time expecte for EAD?

Your i-140 is basically the starting point of the whole process. so, it must be approved first, before moving forward. Of course, you can still apply concurrently, yet the whole process will still depend on your I-140 status.

Yes, it can. USCIS allows adjustment applicants to file the I-765 based on a pending I-485, and employment-based adjustment guidance recognizes that pending I-485 applicants may seek interim benefits while the underlying employment case is still moving. The practical condition is that USCIS must accept the I-485 as properly filed.
