Motion to Recalendar and Terminate
Hello, My lawyer sent to the court of Annandale, VA. My motion to recalendar and terminate; FEB 2023. I called the clerk and he said they received the motions but the Judge that I had back in 2014 was no longer working. My case was adm closed back in 2016. Clerk said that since my case was old and adm closed it stays on federal court so in order to assign a new judge he needed to order my files from federal court to be sent to the state court which is the Annandale Virginia court. Clerk said that he ordered my files on March 03, 2023. He said that after the files get to the court he will assign a new judge. My question is, has anyone in here have had any experience like this and how long does this take; files be sent from federal to state and how long should a judge takes to make a decision on the motion to terminate my removal procedings. Your comments would be greatly appreciated.

@louis calvert it took 5 weeks to the judge make a decision or 5 weeks to your files get to the court?

@louis calvert thank you. I’ll give it till the end of this month cuz he said it will take some time to get my files. first he said a week or a week and a half

Do you apply to the court to recalendar and terminate removal proceedings after having an approved I-130?

@ Aug vel i we have the same here we have a 22 years old case judge reopened the case but not the dismissal part only dhs can dismiss cases now just finger crossed a praying God judge close in my coming hearing again have I-130 approved

@mary fer if you have another hearing; your lawyer should prepare the motion to terminate and present it to the judge on the hearing.

@mary fer if you have your I-130 approved I reccomend you ask your lawyer to send the motion to terminate already so u don’t waste time waiting on the hearing date.

@louis calvert UPDATE: I called the clerk today and he said my files from federal were received and he now needs to put the motions together to give it to the judge; he said he will do that tomorrow. After he saying that, I go ahead and asked him when could I call back to check of any update. He silent for a second then he told me to call him back tomorrow around 3 pm and he will give me an update.

@Aug Vel is in NYC just got it a good news thanks God our case was dismissal last week just wonder how will take to receive the official document good luck to everyone it took total of 9 month from beginning to end

@louis calvert @mary fer GREAT NEWS! I just got off the phone with the clerk and he said judge granted my motion. so it’s terminated. he also said that he mailed them out today.

@Aug Vel pls, what court location is that? how much did your lawyer charge you to send the motion to terminate? also, can I terminate with the court on a master hearing date if I have an approved I-130 in my hand. should write a motion to terminate with me then give it to the lawyer? on my hearing date?

@Jo Long is in Virginia. I signed a contract for the whole process including I-130 so I can’t give u an exact price. I guess if you have an I-130 that is enough proof to ask the judge to terminate your removal procedings. if you have a lawyer he/she might be able to prepare the motion and present it to the judge on your upcoming hearing.
