Motion to recalendar & terminate with the BIA
Hi all,
I'm a DACA recipient since 2012 (legal entry via B2/visitor visa with a removal order admin closed by the BIA). I'm currently working on terminating the removal order and my lawyer is trying to file the motion to recalendar/terminate directly to BIA (no joint motion with OPLA- LA is super backed up) with a pending I-130. Has anyone gone this route and was successful in getting their removal order terminated by the BIA? Please let me know!

@J J nooo, it was received 11/8/24. my lawyer sent a copy to DHS/OPLA too. will update once there’s movement!

any updates ? I submitted joint motion back in August 2024 with an approved PD.
my EOIR doesn’t show this as received though 😭. I have called BIA many times and they confirmed they have my case and its pending.

@Juan C I was super lucky, my removal order was terminated in Dec 2025. My sister was on the same boat but she had been waiting longer since she got married earlier. She was tired of waiting and had her lawyer notify the attorney general inform BIA on intent to sue and BIA acted on her case. The judge was kind enough to act on my case as well since we were initially on the same asylum case as minors under my mom.

how was the process of contacting the attorney general? what state are you in?

@M Lp I didn’t do it, my sister’s lawyer did. She had paid her lawyer to file the mandamus (to sue) the BIA but the lawyer contacted the attorney general first as a warning/courtesy and BIA responded. The lawyer didn’t end up having to sue/file the mandamus in the end. We’re in California.

@Alex Ahmed Kuck & Baxter based in Georgia for my MTR, my sister’s lawyer is Zachary Nightingale based in San Francisco, CA (this lawyer did a lot for my sister and in turn, helped terminating my case too)
