mothers name different in birth certificate
I am the petitioner for my mothers green card. on my birth certificate her name is spelled a little differently. I submitted an affadavit to the effect that both spellings refer to the same person but still I got an Rfe. this is what the RFE says: Submit evidence that shows J…S…and JS are the same person. Evidence of a name change may include, but is not limited to, a birth certificate, marriage certificate, divorce decree, death certificate (of the spouse whose name you used), or other legal document. Acceptable evidence must show it was registered with the government agency authorized to register the document. can I address this using a DNA test to show that she is my mother? I have other official documents with my mothers correct name such as my old Indian passport, my OCI card etc. any help is appreciated.

I’m not an expert but I’ll suggest you get a court affidavit stating that she’s the same person and all documents with the other name remains valid. Then send the affidavit to them. if that was the affidavit you submitted prior I’ll say submit it again.
