marriage based green card (I-130 and I-485) interview while Asylum is pending in court.
Question, I need answers please!! I have a pending asylum application that got transferred to Immigration court, I had my first master calendar hearing back in February but the judge rescheduled it to July 29th. but way before USCIS sent my asylum application to court, my Wife and I had already submitted my I-130 and I-485 application, 2 weeks ago I got a notification that our marriage based interview has been scheduled for July 30th (a day after my second court hearing). so my question is, since USCIS can not adjudicate over my I-485 due to the fact that I’m currently in court proceedings, do I ask the judge to dismiss my asylum application on that day, that way USCIS can adjudicate over my I-130 and I-485 the next day? or is that a bad idea?

you should have a lawyer. you can ask the judge to administratively close the asylum case if you entered the US legally. this is what i did. i am still waiting for the i-130 i-485 decision i had the interview in july 2025.

I’m in similar case. I applied AOS in July 2022 and interviewed was yesterday. in 2024 for asylum interviews time I requested to closed my case as AOS case pending. they closed the case but they issued me NTA last months. and master court hearing in November 2026. both i130 & i485 pending.

@w w did i130 approved ? I requested to withdraw asylum case in asylum interview time but after 2 years DHS withdraw my asylum case and sent NTA. my master hearing is on November 2026. I had AOS interview yesterday but none of application not approved yet . I heard that I130 need to be approved to dismiss the NTA

I don't know. It hasn't been approved yet, both are pending. The judge put the asylum case on hold, giving priority to the i-130 i-485, I can't withdraw or continue the asylum case without getting a decision from uscis on the i-130 i-485.

UPDATE!! we went in for for the I-130 interview yesterday at 7:30am, they didn’t call us in until like 8:45am, and by 9:15am, the interview was over. Everything went well. the officer told us there was nothing she could do about the I-485 since I was already in removal proceedings, which we kind of already knew. long story short, that same day around 5:45pm or so, I got a notification that our I-130 has been approved and the approval letter was already uploaded to MyUSCIS portal and all I had to do was download it from there. they also mailed a copy of the approval letter to us. The I-485 however, was administratively closed. does anyone know the process of submitting the approved I-130 to the court to get the Judge to terminate the removal proceedings, that way I can request to have USCIS reopen and adjudicate the I-485 application?
