@m&m s you will never know until u try. get best immigration attorney, for mandamus there is a lot of Lawers but I would pick Jim hacking from dc.

Mandamus will cost around average around 6K-8K with a good attorney. And Mandamus may also irritate the agency and may rush to give decision and eventually deny, I mean there is chance. And with the current situations we are in the negatives. So proceed with absolute caution and thinking 10 times before making a decision. Good luck

@m&m s I honestly feel like USCIS is being slow in processing cases and then sending out these confusing or generic messages, which can be misleading. At the end of the day, it’s their responsibility to complete the process and make a decision. If something is missing, they should issue an RFE. Otherwise, they should approve the case.
In my opinion, cases that are outside normal processing times are probably sitting with an officer who just hasn’t completed the work yet. That’s why I don’t really trust these responses.
Even when you go through a congressman inquiry, it’s still just a request, it doesn’t force USCIS to take any action. They usually just check the status and send a generic reply. I’ve personally done congressional inquiries for two of my EAD cases when they were outside normal processing times, and both times I received the same kind of generic response saying the case was still within normal time even though it clearly wasn’t. One of my EADs even took 18 months.
So based on my experience, I wouldn’t rely too much on these responses. My lawyer also mentioned that these are standard replies they send to most people whose cases are outside processing times, and it doesn’t necessarily mean anything meaningful.
we’ve already passed background checks when the initial EAD was approved. If there were any issues, USCIS would have sent an RFE ( intial evidence was sent, I saw this with few people ) instead of approving it in the first place. That’s what my lawyer explained, and I completely agree with that.

or do you think the case is just sitting in a pile of dust?
its so heart breaking that they can put us through this struggle, knowing how much we went through already.

@m&m s We can send as many inquiries as we want, but until the agent completes the process, no decision will be made. My lawyer told me to wait. He said that even if we push hard with inquiries, nothing will happen, and he also pointed out my previous EAD inquiry requests.
Unfortunately, these case files cannot be seen even by the call center or their supervisors. The details are only visible to the assigned officer, so there’s really no way to speed things up. The only thing we can do is wait. It feels like everything is stuck, like a backlog across the system.
As you know, my case has been pending since 2019. I also met someone at my lawyer’s office whose case has been pending since 2017. So it’s not just me or you there are many people still waiting.
When I checked the Lawfully app, I saw that only about 20% of cases from 2019 have been resolved, while around 80% are still pending. That shows there are a lot of people still in line.
We could file a mandamus, but I don’t trust the current leadership, so I don’t want to go that route. They’ve already reduced the EAD extension from 5 years to 1.5 years and created issues with advance parole. Nowadays very less vawa approval I am seeing, even approved vawa cases are getting delayed for I-485 process Because of that, I don’t expect anything positive, and I worry they might deny the case.
I honestly blame COVID and the government for these delays.
