Longer Story
Hello all!
I want advice from you guys. I will try to keep this as short as possible.
I came to the US as a F1 Student visa in 2017,
I met my wife in 2018,
We got married late 2019
I applied for I-130 / I-485 with the help of a lawyer that suggested I file it myself with him guiding me through it (family friend). He stated I did not need to file for I-765 / work or travel because I will most likely be approved pretty quick, as well as he did not inform me of the medical form.
Long story short I did biometrics and I got a I-130 Approval.
Within a couple of weeks I also got I-485 denied for misfile (missing part of I-864 )
I graduated college in May of 2020 , but I was still legal until August. I got the notice of denial in April and I reapplied with all the documents in May 2020.
After that I only got a couple of notices such as the form that stated that they can use my biometrics from the filing I had before. until March of 2022 there was nothing there. March 2022 they scheduled an interview and canceled it at the same time.
Until January 2023 I did not hear from them at all. January 2023 they scheduled an interview for Feb 28th…
The interview was very interesting because right away same officer interviewed us separately. She asked pretty basic questions but she seemed like she has suspicions of some sort (acting like shes some secret agent of FBI) and started asking questions if I or my family pay my wife for the green card, which I was shocked for a second because I did not even think of such a question. Keep in mind me and my wife are both in our 20’s , no divorces, no kids with others, no criminal or anything, we both speak English and we both went to college. So once she was finished interviewing she said “You will receive an answer within 30days”…. couple of weeks after I get a notification saying I was booked for an interview… At this point I got in touch and hired an actual lawyer/ attorney. He was very confused why she was giving such a hard time since I-130 was already approved and the notice for the new interview looked the same as the previous one. he contacted a person at uscis and they said the interview was scheduled by mistake so they canceled it.
On may 5th I get another notification that I have interview on June. 5th.. more then 90 days and no answer after first interview. So now I will be showing to the “second” interview, but I can not think of what they could possibly want and what else do I need to prove? I need advice if any of you have gone through something like this.. I am born in Romania but a Canadian citizen and my wife was born and has been US citizen her whole life… couple of days ago it was 3 years since this case has been on going and more then 4 years since I first applied.
I just want to build a family, work fair and square and go on with my life, this is not how any human or to say the least any American citizen should be treated…

Hello oty, I understand your concern. Whenever there is a Stokes interview they suspect a foul play which in most cases they are not always right. What I will advice is if you and your wife know each other well you are good. they will separate you guys again and ask you basic questions that shows co-habitation . how you got to the interview, color of bathroom tiles, kitchen setting , car license plate number , name of both paties parents, food preferences, tattoos, furniture settings, job location (how both parties commute) , how did you meet , who proposed etc those are the likely questions. Also I will suggest any documents you feel can proof bona-fide marriage plz do not hesitate to go with it. Life insurance (ensure the beneficiary knows amount paid monthly) health insurance, more phote albums etc

I am deeply sorry to hear about your situation. That said, I agree with @A A . They definitely don't like something about your case. You and your partner should discuss your life history from the minute you met to the moment you enter the interview room. How you guys met, where, who was there, when and where was your first date, second date, and third date, how did the relationship progressed after the 1st, 2nd, and 3rd dates? At what point would you say you guys were in love, basic information about yourselves like full name, DOB, where you were born, parents' names, the date you got married, where you got married, who was there, addresses you've lived before, and their timelines. And basic questions in your day-to-day life like where you work, position, boss name, when he/she leaves for work, work address, basic household questions like no of rooms, bathrooms, kitchen questions, TV brands, shows... Look up Stoke interview sample questions online.
I also encourage you guys to live an intentional life during the final two weeks before you go in. Like what you guys did over the weekend to the interview, your last movie date, dinner date, last time you visited a family, who, and when, who went to bed first the night before the interview, who woke up first the day of the interview, who showered first, what did you eat, did you guys stop to get coffee? Or to use the bathroom, who drove there? And who's car?

Understand there is no such thing as a "simple immigration case". In fact, it is the simple ones that end up complicated. Always plan for the worst-case scenario.
This app saved me from a similar situation. Prior to my interview, I asked myself, "What if they separat us?" Fearful of what might happen, I looked online for sample Stoke interview questions and found over 300. Every day, my wife and I went over them one by one to make sure we are on the same page.
Lo & Behold we were separated and asked the same questions I had gotten from online sources. We were approved on the spot !!!

in my opinion, you don’t have to worry. They are doing their job by playing Devil’s advocate. And they also have to do their job and approve your case, because you have everything that proves you are for real. They can’t go against the proof, and in the odd case that they do it, you still have the legal resources to fight it.
