Hi My daughter is trying to get her license as a 16 year old
in the permit there’s this question
“are you in the country legally ?”
how am i supposed to answer that question.
we came here with visa and stayed, we been living here for more than 3 years and I have already started a VAWA Process.
I know it’s to much info but if someone out here can help that would be great,

the answer is No. if your vawa hasn’t been approved and you haven’t been granted deferred action, you’re not here legally. I see your abuser is an LPR so I take it you have to wait for your vawa to be approved to get an EAD since you can’t file i360 and i485 concurrently.

@Q U Did you apply for EAD card? If yes, did you get it yet? Also, did you receive the PF from your VAWA yet? Lastly, what state are you located at?

@Q U if you added your daughter to your VAWA application and your work permit application has been approved, including hers, then YES she is in the country legally, because you cannot be living illegally in the U.S and be issued a working permit, that’s not how it works

As long as you have a prima facie tou area authorized to get a license, you will get the learners permit first after they verify your information with rhe DHS via SAVE. I did it and I'm on the process ofcgettibg the actual license, if you havebtour license tou will have to apply for her.

O and once DHS verify your information under VAWA your letter will say that you have lawful status

legally means if you came to the country thru inspection “legally” and still have a valid status ( such as having a pending adjustment of status ) yes you are here legally
