B2 visa is your backup if you dont find one. May I ask you have a EB1 using a PhD? which area?

no my date is not current yet

to be honest you are legally not allowed to stay in US. so best is to hope and find a employer that can transfer your h1b. you cannot have gaps in h1b. payroll needs to run always while on h1b.
