I’m in the same situation, avoid the appeal at all cost!! I’ve been waiting on a Motion to Reopen/Reconsider since June 2023. USCIS made a clear mistake in interpreting the requirements. My lawyers thought an appeal would be an easy fix, but it’s turned into a painfully long wait of over five months without any updates. I’m certain that if we had filed a new petition instead, I would have obtained my L1 VISA months ago.

I don’t know why lawyers still have faith on that, my lawyer said the same thing, “it’s going to be the same officer and it’s a easy fix one they see it” so they filed a “motion to reopen/to reconsider” which is basically the same thing now the USCIS has been successfully ignored my motion for six months, unfortunately that was the Company’s decision but if you have any power on that decision I really encourage you to re-apply with premium, it’s the most expensive option but the fastest one because trust me you don’t want be in my position waiting on a Motion for six months, you might lose the chance to get the job offer. Just think a about it… filing a motion it’s basically telling them they made a mistake and they need to fix it, we know they don’t want to hear that, they would rather work on new applications and leave the motion wait as much as they can until it doesn’t really matter anymore, but it’s there’s no way around and you are trap in a motion already ask you lawyers specifically how long will they wait before calling the USCIS for an update if the case hasn’t been approved, chances are they will say 90 days, make sure sure they do it also make them give you a plan B If the motion takes to long don’t let them feel that you can just wait and see what happens

contacted local senator, he sent a inquiry to USCIS and received a confirmation that the case is in queue for review in Dec 20, no updates since then :/

quick update, yesterday my case was reopened, approved then reopened again, so I don’t what’s going on I haven’t heard from the lawyers or seen another approval, but at least the case is now reopened for reconsideration

how to contact local senator by letter or by meeting personally.looks like it worked for you uscis knows that they cannot just reject the senator request and have to be on fair side

Thank you! the lawyers received a approval notice by email they believed it’s finally approved and the updates are just out of order, the senator had definetly an influence and you can ask for their help only when your case is out of normal times (over his/her website, otherwise they will ask you to wait but tell your lawyer to consider a “Congresional inquiry” once your motion is over 4 months. I will let you know when I get the physical approval notice, that will be the final prof that my case was approved
