L1a extension - abroad or U.S.?
hi! looking for POV/advice here. In the process of filing for L1A extension (Expires on dec 2025) - EB1C GC i-485 currently pending. two scenarios: -file for extension within the US (Lawyers are highlighting the fact that USCIS is being more strict and there’s more scrutiny for employment based cases, and denials and RFEs are more common (in case of denial i guess i will still be protected by the pending i485) -go abroad and stamp in the consulate, which apparently is more easy, but if i leave and extension gets denied i will be stuck abroad without being able to come back in any experiences? how true is it that USCIS is deniying more L1 extensions and cases?

I didn’t know the L1A could be renewed without leaving the US. My attorney has always said that I would need to exit the US to renew it, preferably in my home country. If you can renew without leaving the US that’s good. In case it gets rejected you have the fall back option of using your EAD. If you also get rejected on the AOS at the end, you would have the option of going abroad for requesting a new L1A. But hopefully that won’t be needed.

Do you have advanced parole? Have you checked if L1A is a dual intent visa? Leaving the US might render your green card abandoned so might be best to consult a lawyer.

I made it abroad going back to my origin country in April 2025. The most important thing (according to my attorney) is don’t do it before your biometrics has been taken. I filled my I-485 on Feb 24, biometrics taken on Mar 19 and I leave the country on Apr 4. Smooth process at embassy and I got my renewal for 2 more years. You are allowed for multiple entries with your L1A visa even if your I-485 is pending. Good luck!

you don’t have to leave the country for extension. just have ur lawyer apply for L1A extension through USCIS.
