L1A expiring in November 2025 (7 years). I have an approved I-140 under EB1A. My PD is June 2023.
My L1A is expiring in 11 months from now. The final action date is still Feb 2022. It’s not moving for various reasons including EB2 portings.
What are my options to stay here if my date doesn’t becomes current?
1. H1B isn’t an option. Employer doesn’t do it.
2. any letter to senator will help?
3. any special circumstance clause?
please share if anyone has gone through this predicament and what they did.

So one thing no one can do is issue a card when the date is not current. if the date does become current for filing at least, you can expedite the EAD. If the filing date does not become current for you, then no option other than moving out of country and coming back after one year cool down, then adjust status once date is current.

I would say be prepared to move back . Things are only going to get tougher next year . But talk to a lawyer and don’t rely on opinions here .

I see this option, I am not sure of the success rate of getting EAD via this process.
Has anyone tried compelling circumstances argument?

have you stayed out of US continuously for a year.
if so you can get fresh L1A
if not go back and you can plan to come back with new L1 after a year

I have not stayed outside US for any substantial period. That is not an option unfortunately.

@A T you need to change to any other visa like O1 or H1. Based on the pending visa numbers I dont see the possibility of dates (India) moving to April 2023 in coming 2 years. I hope I am wrong but the numbers seems to say >2 years.

thanks Chin, that’s my thought as well. I don’t have an option of changing to O1 or H1. My employer prefers that I work internationally.
