K1 Visa 2 Year Rule in relation to COVID
Hey, so back when we filed for our k1 last year, the application was accepted about 2 weeks after last we met in person, 2 years prior. We decided to apply anyways because it wasn’t possible for us to meet due to the COVID border restrictions in Japan. I wanted some takes from others in the community because I know this could get us denied and I wanted to hear if anyone had done something similar and had any experience to share. Keep in mind we did end up seeing each other 6 months later after the travel restrictions were lifted on where she was, which I mentioned in the petition we would do as soon as possible. We also saw each other here in the US for a few weeks, in January, but I’m not sure if anything that’s occurred after the applications submission counts.

N.H, your situation is eerily similar to ours, we just received a notice of RFE on Monday, I will let you know how it goes for us. What did the RFE request from you?

Before our application, we had last met in Feb of 2020. Our timeline is Feb.2022-2023. I’m hoping with the influx of COVID related cases they’ve changed their policy in the last 2 years.

I am part of another K1 group and there were a few couples who were denied for not meeting within the 2 year requirement. They had situations similar to yours.. COVID closures were not accepted as a valid reason for approving their cases. One of the couples had been dating for years before filing and had seen one another multiple times. Those visits did not matter since they were all outside of the 2 year period. The 2 year meeting eligibility requirement is firm and really hard to fight.
