K-1 VISA AOS(I-485)
hello
my husband came to usa with K1 visa on 12/17/23 and we got married on 12/27/23. On 1/22/24 we applied for I-485 but due to the incorrect processing fee case has been rejected for 2nd time. I would like to know if his K1 visa expire and we are trying to apply for AOS does it matter?

You can adjust your status whenever you want as long as you have been married within 90 days you will not have any problem.
