@tired from waitingg I think the processing time on USCIS website is 40.5 months. So you're technically outside processing time and can contact USCIS to request for an expedite.

@tired from waitingg you should reach out to them. You have a right to have your case adjudicated in the normal processing time. They have a 6 month gap where they ask you to wait before contacting them, but you're also outside of that. Write to them! Send copies of your I-797 notices and whatever you need to. In fact, they give guidance for this so do it. Don't just sit and wait for them to do the right thing.

@Kerry S what if they get triggered and asked rfe because i send everything i can dont wanna stress out for rfe
Kerry SSep 17, 2024
@tired from waiting it's not about the rfe...it's about your priority date, which is well outside of normal processing time. They shouldn't get triggered because you're asking them to live by their process. I get if you're nervous and don't want to draw attention, but you should inquire. They tell you to do that if your case is outside normal processing time.

@tired from waitingg I applied with my son. I missed his biometric appointment because the IRS had his passport at the time they wanted me to go. I requested a new date, which they never responded to. Sometime last year I sent a letter to them, reminding them they never responded and I'd like a new date. I had applied for his EAD at the same time. I got notice for the EAD and received it a few months later, and then got vawa approval right after as well. They never responded about the inquiry but I know they received it. All that to say, there's nothing wrong with you asking and proving that you've been waiting for longer than you should. Might trigger an approval instead.
