Job offer and no EAD
Hello. I filed for my adjustment of status in September 2020. (i485 with i765) I have a receipt from USCIS for case received from October 2020. Biometrics were taken in late February.
I now have a really good job offer but I'm still waiting on an update for my EAD card.
How should I progress? Should I accept the job offer and give them a later date? Should I enter an expedition request to uscis?

I’m literally in the same situation and similar filling date. I was super honest trough out the interviews and hiring process, so they told me they can wait for me until my EAD arrived

the job offer is a good reason to expedite. You’re very likely to get approval. The whole process should be between 3-4weeks (maximum) if done right and approved. You will have your card in the last weeks

My lawyer told me a job offer is not a reason to expedite

@santiago Ortiz. it is not listed as reason. But others have requested to expedite on this reason. And it has worked! Just do it on your own. This won’t affect the outcome or the processing of your case regardless of approval or denial of the request to expedite. I also have a lawyer but I did the expedite and inquiries by myself. Lawyers usually have more important stuff to do than to try and call and wait for 30 minutes for an agent.

@elvis a Thanks for the insight!

the job offer is not a good excuse to file an expedited request, unfortunately. USCIS will grant the expedited request if there is a severe financial loss (job loss or job offer does not qualify), urgent humanitarian reasons(you working for the UN, essential worker or DHS worker for example) or clear USCIS error. They are very picky and only a handful of people gets approves. However, try it out, request it but keep your expectations to a minimum. Doesn’t hurt to try!

@elvis did your expedite work ? what is your case ?
elvis aMay 15, 2021
I would say it was more of a coincidence. So I submitted the request on Friday around 11:30am and by noon my status already updated to new card being produced. So I’m not sure if it was the request or it was just that my case was going to be approved regardless. So coincidence idk but I do have the request to expedite applied in my case so I’m not sure.

also my case is marriage based to usc. PD September 14th 2020

@elvis how did you submit? did you send mail to them or fax or Emma chat?
elvis aMay 15, 2021
@karp c. First, you can’t just email or fax them, it won’t work at all, they won’t even acknowledge it. I used Emma chat. But I had to try multiple times until I got a nice agent/ tier1. Not trying to discourage you. But sending random emails or fax to uscis just won’t work. If they don’t request something from you they won’t accept it.

@elvis I asked congressman to submit it on my behalf with a self affidavit letter asking them to expedite + evidence , they said they submitted. it’s been 9 days not heard anything yet. Don’t know what else I can do now
elvis aMay 15, 2021
@karp c. ok that’s different. Usually with a congressperson you have to wait a certain amount of days counting only business days since uscis don’t work on weekends. From what I have read with a congressperson it can take up to 30 days “I’m not sure tho”. but if you already submitted you just gotta wait

@hammad, I recommend doing both at the same time. Regarding the expedition request, you can file with the potential employer’s request. Of course, it could be less powerful than the severe financial loss case, but it doesn’t mean that you cannot file at all. I filed by talking with a tier 2 agent via call (case opened via Emma chat). You can find my timeline from the reply in my post about the EAD expedition request.

Hi all. I have submitted my OPT request and i have a job offer letter and I am worried that my EAD card won't get on time.
My question is where and how do I submit to the USCIS my job offer letter so the might consider an expedition of it?
Thanks.
