Should not apply when there is retrogression. Everything will be accepted (including biometric appointment) but when it is your turn, the application will be denied without any refund since it was applied when there was a retrogression. Will just waste time and money.

March 4, 2019 EB4 still no update 😏
Jagjeet SinghJan 3, 2024
@Hon Haw Its just $1225 Fees.. For that you will get 5 Years work Permit and 5 Years of Travel Documents.. What else do you want?
H
Hon HawJan 4, 2024
@Jagjeet Singh First of all, you won't get any work permit or travel document for filing I-485 (AOS). If you want to obtain a work permit and travel document then must be I-765 and I-131. Secondly, there are several requirements and options to file I-765 and I-131 (base on different categories), and pending I-485 in Eb4 case (either concurrent filing or I-485 receipt). And they are only approved if I-485 was filed properly which including the requirement of the filling date satisfied the bulletin of the filling month (and this is not only applied to retrogression but also in a period of sunset date or using the wrong table in the bulletin - this happened with one of my friend and she has to reapplied (just for 15 days something different due to using a wrong table)). Well, attorneys are not filing during retrogression because of these reasons. So far I don't see any changes, but if you believe that how it works and what $1225 can get you for ignoring the bulletin then good luck!

@Jagjeet Singh is that combo card?
Jagjeet SinghJan 13, 2024
@V N USCIS stopped issuing Combo cards years back.. They issue Travel Docs separately..
Jagjeet SinghJan 13, 2024
@Hon Haw FYI too.. Work Permit approved..
Vishnu DasJan 14, 2024
@Jagjeet Singh that’s so amazing! What you’re saying is certainly happening although all attorneys are in denial. My attorney says that our AoS and any work and travel permits issued will be cancelled when USCIS realizes its mistake. But so many people including yourself, my colleague and others on this forum have had AoS applications accepted without PD being current. So I don’t think that USCIS is making a mistake for so many people. My colleague is waiting for biometric and work permit and advance parole. So very happy to see that you got yours!
Jagjeet SinghJan 14, 2024
@Vishnu Das Mistake happens for few cases but not for all cases.. Secondly, these Work permits are and travel docs are issued for 5 years.. I know many who have travelled to their home country on these AP docs and working.. But yes, there are chances that if I-485 files are opened, they might send it back saying date is not current.. meanwhile we have our work permits to stay within USA..
Jagjeet SinghJan 17, 2024
@Vishnu Das finally.. my AP also got approved today.. Within 2.5 months I-765 and I-131 got approved..

Hon HawJan 17, 2024
@Jagjeet Signh: I'm just here to support people, and not in the same boat of seeking any cards, but thank you for the FYI and congrats thus! @Vishnu Das: your attorney is absolutely right. I saw a lot of EB4 - religious cases since 2012, and I agree with your attorney. The choice is your thus, just keep in your mind that only greencard is a permanent card. Any other cards of course have their advances but temporary as well. Mistake once discovered may not be taken back for permanent one but for temporary ones it may be haulted. Additionally, the current retrogression is caused by a massive legal error, so mistake not happens only with some cases but all the cases as well. No one wants anything that is out of normal practice and may affect the permanent result.

@Hon Haw is there anyway I can change my employer while I’m waiting for status adjustment over 2 years, as of I know that there is no supplement J for eb4 religious workers, but it is a kind of Harassment as waiting this long and there is no way to keep legality, some cases employers removing priests and some other cases exploiting of work, I’m looking for a best option, thank you
P
Prince BJan 17, 2024
@V N you can change your employer but they have to file the petition again for R1 and then transfer. it’s a long process.. by that time your Green card will come. current processing times for R1 is 11-18months.
