Issues proving eligibility 540 days EAD Extension
My EAD c10 expired in 08/2023 and we submitted back in June my application for renewal. as it turns out, the 797 notice only says biometrics don’t need to be recollected and in the top right corner where it has the code, there’s an “N/A”.
Right now I’m facing termination. because my employer wants some document stating I’m eligible for the 540 days extension and it doesn’t matter how many times I give them the links at uscis website but it’s not enough.
Does anyone know if it’s possible to get a letter from USCIS attesting this extension?

give them your receipt notice from USCIS for the i485. That’s what I gave to them to prove that I had an active application in the right category.

@marcus ss Your employer cannot terminate you as long as you have the EAD renewal receipt. The USCIS website clearly states ‘eligible for extension for upto 540 days if applicant applied for renewal’. This is proof enough. Tell your employer that’s how it works. What more proof do they need besides the government telling them that, ‘yes your employee is right’ lol If they terminate you, you have strong grounds to sue

@Sandy will Migrate lawyer was contacted and provided everything we have and they’re still not convinced I’m eligible because the notice doesn’t state anything about my extension eligibility

ask your lawyer to write to them stating the position of the law. They are prohibited from terminating you for that reason. they can also check on SURE and they will see that you’re eligible. also do an infopass and explain your situation.

we did. talked to their leadership department regarding i9 verification. they’re not flexible. they’re stating the extension period is optional.
