is it safe flying with ADIT stamp while on process?
Hi everyone, I’ve been in the VAWA process for about a year and a half now and had a few questions. I previously had a 2-year green card and started my VAWA application while I still held it. When my green card expired, I visited a USCIS office to request a passport stamp (ADIT), but since my passport was close to expiring, they issued me a temporary ADIT page instead—a document that functions like a 1-year green card, rather than stamping my passport. My question is: can I use this document to travel internationally, or is it not recommended? Thanks in advance for any advice.

@Joe S I don’t under why did you apply for VAWA instead for unconditional green card??? You could if you can prove your marriage ends because of abuse… it’s faster and more effective

I'm confused on many levels here. First, if you went to the uscis office and got this stamp, why didn't you ask them versus coming here to ask us inexperienced and less knowledgeable folks? Second, the purpose of applying for vawa is to establish a basis for getting a green card. You were already approved for a conditional green card, but then applied for vawa to get a green card again under a different basis? Why not get a lawyer for when you go in for the interview to get the 10-yr green card when the conditional green card expired, and establish a basis for why you and your spouse separated, such as due to abuse? There must be more to the story but long story short, no one here can advise you because we don't know the full extent of your circumstances. I'd recommend consulting with a knowledgeable lawyer.

@survivor p You cant do that. after the 2 years green card expired you can extend it, and they ask you to choose if you filing together for extension for permanent green card or you filing separate beclcause you were abused. it makes it automatically vawa if you file separated. the reason I filed vawa is because I was attacked by my mother in law and she was arrested for attacking me

@Kerry S Of course I asked them this question in the office, and they told me it's good for flying. I am still scares through that suddenly they will arrive to a decision while I am not in the USA and then I won't be able to come back inside so I was asking if someone did it :)

@Kerry S I filed for unconditional green card when my 2 years green card was about to expire and when I was in the middle of the divorce process with my ex wife. I think it's called I765 to remove conditions. when you file the form they ask you if you file together ot separate and if seperate then why? I couldn't choose we divorced because we were in the middle of the process of divorce. and I couldn't choose filing together because we were not filing together. there was another option to choose that that reason you file separated is because you or your kids were abused by your us spouse or family and that was the case with me. I was attacked by mother in law and she was arrested for it and I have a restraining order from her and my ex wife was trying to blackmail me for papers and ask 50k for it many times and I have it recorded. I had to share all these evidence with uscis and that was my only way. even though it is not counted as a regular VAWA, when I went to their offices for the stamp, they told me it's considered as vawa because I already had a green card but ask to remove the conditions of the temporary green card based on abuse so it make it vawa. does it make sense dear?

@Joe S wow! Thanks for taking the time to explain. Uscis seems like the IRS...they have so many rules they start confusing themselves. I would say, based on your fear of getting an approval or other decision while you're gone and you're afraid you might not be able to come back, don't go! Always err on the side of caution because you don't know what will happen.

why don’t you renew your passport with your consulate then have USCIS stamp that new passport

@Kerry S for you to get a greencard it has to be based on an available visa (marriage, employment, vawa, refugee,DV etc), for Joe his visa (i-130) was no longer valid since divorce had already started, so he couldn’t remove conditions with that visa he has to get another visa available either remarry and get another i-130 approved or self petition. Unfortunately immigration is very complicated and you can’t just switch from one thing to the other you have to go through due diligence to make sure they cannot come back and retract the greencard later on. What he did is the only legal way to make when he gets his 10 yr GC they cannot come after him. had he removed conditioned and failed to state he was already in divorce processes they could come back years later and retract the GC and deport him for misleading to gain benefits.

@blessed & favored you are right, this is exactly my case. and that was my only way. I have 2 kids here in the US from my first marriage. I pay child support of $827.50 per each child every month and additionally 50% of daycare cost and medical insurance (ending up in around $2800-$3000 every month). I have my big brother marriage in 3 months and I really want to fly, but I am really afraid for them not to let me back in especially when I have 2 kids here. the fear of being refused entrance because of a small mistake and not be able to see my kids for the next 13 years I can't stand the thought.... on the other hand not going to the wedding of my brother.... 😲😫
