Is it okay to file tax as married-separately?
Hi, guys. My wife and I have filed for a marriage green card and we just have our interview left. I have a debt with the irs so for last year's tax filing, I was advised to file as marriage-separately. Would filing separately negatively impact our chances with the USCIS?

my lawyer words: Filing taxes as "married filing separately" should not impact their immigration applications. They are not misrepresenting that they are married and there are several reasons why they may wish to file separately. From an immigration perspective, there should be no issues. However, they should make sure to file as married.

it should not maybe be a problem but its up to uscis to ask you why you guys dint do married filing jointly.just make sure to take more evidence when it comes to the interview.

I did that and during my interview for citizenship, I was asked the reason behind doing it married separately. After giving my reason, the interviewer had no issues. Incase they ask you, let them know the reason.

would she get a refund thats why you want to do it separately? my experience is: my husband has a debt with irs long before getting married and he is doing a payment plan. and Im getting refund for last year . since we want to do it jointly(i dont want to take any chances with uscis) im gonna add the form 8376, which is injure spouse form in order to get my refund. still doing it married jointly. i think it looks better this way, also my lawyer adviced me this, than do it separately.
