Is it faster to apply for a F2A in Nebraska
Once I’ve receive my green card I will get married to my girlfriend and request a F2A visa to her. Is it faster to request in USCIS on Nebraska (instead of California where we are living)? how long does it usually takes? and what about a travel permission, how long does it takes there on average to be approved? thanks all

You cannot choose. Is your girlfriend already in the US? By the way, if she is not in the US, it is going to take a while before she can come over, a friend of mine who’s a US citizen his wife finally coming to US after more than 2 years of waiting. All the best!

If she is adjusting her status while she is in the US then she should a have a valid “status” ( she cannot let her I-94 expired). If you were a citizen then yes, she can over stay. So, if you receive your green card then get married, then apply for her while she is in status then that should be good.

Keep in mind that she cannot adjust status before her visa expires. F2A are capped at about 100k a year. So there isnt a visa readily available as would be with a US citizen filing for a spouse. They dont forgive overstays for spouses of green card holders. Only immediate relatives or US citizens

I could be wrong. But do some research before adjusting or overstaying

we’ve submitted a I797 form for her (for a i539 - application to extend change non immigrant status). Her i94 already expired but according to our lawyer she can stay her in the us while the student visa request is being evaluated. I have a work visa and am waiting for my family based green card interview. once it’s issued we will marry and apply for a F2A (i130 and i485). And she’ll continue to wait for her green card here.
